ROAD CONSTRUCTION AND MAINTENANCE AGREEMENT, 52nd Avenue State Highway Commissioner Richard Backes expects Cass County to abide by their agreement of' 1980 with the State ttigh~.~'.>, Department and continue to maintain 52nd Avenue South from University Drive to Interstate 29. In a 'letter to States A'ttorney Rober-'t Ho?, Hr-. B:~ckes suggested that Cass County and tt;e cities of Fango and Frontier should meet to determine the appropriate improvement and 'the obligation of each jurisdiction. F-M Asphalt Co. laid 63 ton of asphalt on three miles of this road aL Mr, Richards request because he felt it needed to be repaired this fall before someone was hurt, He recommended a further response 'Lo the State's letter and find out.who is going to have the jur'isdiction of that road. NOTION, passed Hr. Shannon moved and Hr. Wieland seconded to ask the States Attorney in cooperation with the Engineer to draft a follow-up letter to the State Highway Department that Cass County feels they have abided by the agreement and do not wish to continue performing above and beyond that agreement; but that Cass County is very much interested in meeting with the groups suggested in Mr. Backes' letter, along with Barnes and Stanley Townships and the State Highway Department, to seek a solution. Motion carried. 12. U.S. WEST COMMUNICATIONS, Utility permit NOTION, passed Hrs. Toussaint moved and Mr. Shannon seconded to approve a utility permit for U.S. West Communications to place buried cable across County Road 28 south of the fairgrounds. Motion carried.
