Comm, Minutes--June 6, 1989 264 <br /> <br />Mr. Shannon felt that the time to file a protest on a special <br />assessment district would be before bids are opened. Mr. Solberg <br />stated that he did not want to jeopardize the Sleepy Hollow project, <br />but he felt there is a lack of communication between the County and <br />townships on these type of projects. He stated that townships do not <br />hear about these special assessments districts until they read about <br />it in the newspaper. Mr. Shannon stated that the newspaper is the <br />County's legal record. <br /> <br />Robert Hoy felt the law would allow for a maintenance fund, but the <br />property owners would need to know this up front. <br /> <br />County Engineer Don Richards questioned the township's responsibility <br />for road repairs before they have placed the road on their system. <br /> <br />Steve Dewald, Engineer for the Sleepy Hollow project, stated that he <br />will have an opportunity between now and the next County Commission <br />meeting to discuss the bids with the property owners at Sleepy <br />Hollow, and he will make it known to those people present that they <br />are responsible for their own repairs should they become extensive. <br /> <br />11. ROAD CONSTRUCTION AND MAINTENANCE AGREEMENT, 52nd Ave. south <br />Don Richards requested that the Commission review a construction and <br />maintenance agreement signed in 1980 on a portion of 52nd Avenue <br />South from University Drive to Interstate 29, and petition the State <br />Highway Department to relieve the County of the responsibility of <br />continuing to maintain that portion of road. He felt the County has <br />fulfilled its responsibility and that it was never intended that the <br />County maintain it for this length of time. Mr. Sondrall agreed <br />that, at the time, the County Commission felt they would be <br />maintaining this portion of road for 4-5 years. MOTION, passed <br /> Mr. Sondrall moved and Mrs. Toussaint seconded that the <br /> States Attorney draft a letter to the State Highway <br /> Department informing them that Cass County wi]] no longer <br /> maintain the portion of 52nd Avenue South from University <br /> Drive to Interstate 29, as recommended by the County <br /> Engineer. Motion carried. <br /> <br />12. FLOOD DAMAGES ON ROADS AND BRIDGES, Report from FEMA <br />Don Richards reported that he has received a summary of flood damages <br />from the Federal Emergency Hanagement Agency, and the County is <br />eligible for reimbursement of $111,467. He estimated $69,000 worth <br />of damage to County roads on the Federal Aid System that do not <br />qualify for FEHA funding. He requested the County Commission to <br />reimburse the County Highway fund from the Emergency Fund for this <br />expense plus $29,780 which was spent on overtime for snow removal <br />after January 1, 1989. MOTION, passed <br /> Hr. Shannon moved and Mr. Wieland seconded to allow for a <br /> transfer of funds in the amount of $98,780 from the County <br /> Emergency fund to the Highway Department fund for the <br /> emergency expenses that were incurred. On roll call vote, <br /> the motion carried unanimously. <br /> <br /> <br />
