Comm, Minutes--June 6, 1989 263 duly published as required by law, and that no less than thirty days have expired since the first publication thereof, and the opportunity having been afforded as provided by ]aw for the property owners liable to be specially assessed for said improvement to file protests against the making thereof, and this Board having duly met to consider all protests so filed, and being fully advised in the premises, it is hereby determined that not sufficient protests were filed within the time and manner provided by ]aw against the making of said improvement; therefore, the Board of County Commissioners and this County are authorized to proceed with the construction of the same and to pay the cost thereof by the levy of special assessments. On roll ca]] vote, the motion carried unanimously. 9. BID OPENING, SLEEPY HOLLOW STREET IMPROVEMENT The County Commission proceeded to consider the matter of bids for the furnishing of materials, labor and skill needed for the construction of asphalt paving and related items and all other appurtenances, contrivances, and structures for Street Improvement District No. 1989-1 of the County of Cass, North Dakota. Sealed bids having endorsements upon the outside of the envelopes containing each bid, stating what the proposals were for, were on file with the County Auditor from the following persons and firms: Northern Improvement Company, F-M Asphalt, Inc., and Border States Paving. SPECIAL ASSESSMENT DISTRICTS, Communication with townships Mr. Warren Solberg, resident of Stanley Township, requested time to speak about the problems townships have when special assessment districts are created for street improvements. As former Chairman of the Stanley Township Board of Supervisors, he stated that the township receives requests when road repairs become necessary, and they do not have the funds budgeted or the expertise for rebuilding a road. He suggested an additional assessment for a year to be set aside for future repairs of that road. He also suggested a County policy whereby property owners in a special assessment district are responsible for their own road repairs.
