Comm, Minutes--June 6, 1989 263 <br /> <br />duly published as required by law, and that no less than <br />thirty days have expired since the first publication <br />thereof, and the opportunity having been afforded as <br />provided by ]aw for the property owners liable to be <br />specially assessed for said improvement to file protests <br />against the making thereof, and this Board having duly met <br />to consider all protests so filed, and being fully advised <br />in the premises, it is hereby determined that not <br />sufficient protests were filed within the time and manner <br />provided by ]aw against the making of said improvement; <br />therefore, the Board of County Commissioners and this <br />County are authorized to proceed with the construction of <br />the same and to pay the cost thereof by the levy of special <br />assessments. On roll ca]] vote, the motion carried <br />unanimously. <br /> <br />9. BID OPENING, SLEEPY HOLLOW STREET IMPROVEMENT <br />The County Commission proceeded to consider the matter of bids for <br />the furnishing of materials, labor and skill needed for the <br />construction of asphalt paving and related items and all other <br />appurtenances, contrivances, and structures for Street Improvement <br />District No. 1989-1 of the County of Cass, North Dakota. <br /> <br />Sealed bids having endorsements upon the outside of the envelopes <br />containing each bid, stating what the proposals were for, were on <br />file with the County Auditor from the following persons and firms: <br />Northern Improvement Company, F-M Asphalt, Inc., and Border States <br />Paving. <br /> <br />The bids were opened and made public. <br />bidder's bond in the amount of 5% of the bid. <br />following amounts: <br /> Bidder Amount <br />Northern Improvement Co. $ 43,670.20 <br />F-M Asphalt, Inc. 46,868.80 <br />Border States Paving, Inc. 49,355.30 <br /> <br />Each bid was accompanied by a <br /> The bids were in the <br /> <br />Alternate <br />16,482.00 <br />18,954.30 <br />21,261.78 <br /> <br />MOTION, passed <br />Mrs. Toussaint moved and Mr. Shannon seconded that action <br />on said bids which were opened at this meeting relative to <br />this improvement in Street Improvement District No. 1989-1 <br />of the County of Cass, North Dakota, be deferred until June <br />20, 1989, at 10:00 AM. On roll ca]] vote, the motion <br />carried unanimously. <br /> <br />10. SPECIAL ASSESSMENT DISTRICTS, Communication with townships <br />Mr. Warren Solberg, resident of Stanley Township, requested time to <br />speak about the problems townships have when special assessment <br />districts are created for street improvements. As former Chairman of <br />the Stanley Township Board of Supervisors, he stated that the <br />township receives requests when road repairs become necessary, and <br />they do not have the funds budgeted or the expertise for rebuilding <br />a road. He suggested an additional assessment for a year to be set <br />aside for future repairs of that road. He also suggested a County <br />policy whereby property owners in a special assessment district are <br />responsible for their own road repairs. <br /> <br /> <br />
