Minutes--March 21, 1989 213 <br /> <br />38.CO. COMMISSIONERS, Board membership <br /> Mr. Shannon stated that he attended a meeting where former <br /> Commissioner Jeannette Stanton informed him that he may be the <br /> representative of the Cass County Commission but she was the <br /> Commission representative of the citizens of Cass County. <br /> Mr. Shannon proceeded to read a resolution ~hereas individuals <br /> appointed to various boards by the Cass County Commission are held to <br /> serve at the will and sole discretion of the Cass County Commission. <br /> MOTION, passed <br /> Motion was made by Mr. Shannon and seconded by Mr. Sondrall <br /> that the Cass County Board of Commissioners remove former <br /> Commissioner Jeannette Stanton from its Social Services <br /> Board "without cause" as is provided under North Dakota <br /> Century Code 50-01-10 and that this resolution be prepared <br /> Wednesday, March 22, 1989, and sent the same day to the <br /> director of the North Dakota Department of Human Services <br /> for concurrence on or before March 31, 1989 so that this <br /> Commission can reappoint a new member at its will and sole <br /> discretion at its April 4, 1989 meeting. He provided <br /> Commissioners with copies of the February 14th minutes <br /> authorizing the Chairman to send letters by registered mail <br /> to former Commissioners Larson and Stanton requesting <br /> resignations from boards to which they were appointed at <br /> the time they were elected County Commissioners. The <br /> motion carried on roll call vote with three members voting <br /> "Aye", Mr. Eckert and Mr. Wieland opposing. <br /> <br />39.CO. COMMISSIONERS, Tenure of appointments <br /> Chairman Eckert asked the States Attorney if there are any boards or <br /> committees where former Commissioners' positions would not be <br /> terminated at the time they are no longer a County Commissioner. The <br /> States Attorney referred to a letter he wrote to the Commission dated <br /> January 6, 1989, regarding tenure of Commission appointments. <br /> <br />40.SOCIAL SERVICES, Joint resolution <br /> MOTION, passed <br /> Mr. Shannon moved and Mrs. Toussaint seconded that the States <br /> Attorney draft an appropriately stated joint resolution for the <br /> Chairman to sign and to be mailed on March 22nd to the State <br /> Human Services Department for removal of County Social Service <br /> Board Hember. Motion carried. <br /> <br />41.CO. COMMISSIONERS, Board membership, reconsider initial motion <br /> MOTION, passed <br /> Mr. Shannon moved and Mr. Sondrall seconded to reconsider the <br /> initial motion regarding former Commissioner Jeannette Stanton. <br /> Mr. Shannon stated that this would give Commissioners Eckert and <br /> Wieland an opportunity to rethink their vote. Motion carried. <br /> <br /> <br />
