Minutes--March 21, 1989 213 38.CO. COMMISSIONERS, Board membership Mr. Shannon stated that he attended a meeting where former Commissioner Jeannette Stanton informed him that he may be the representative of the Cass County Commission but she was the Commission representative of the citizens of Cass County. Mr. Shannon proceeded to read a resolution ~hereas individuals appointed to various boards by the Cass County Commission are held to serve at the will and sole discretion of the Cass County Commission. MOTION, passed Motion was made by Mr. Shannon and seconded by Mr. Sondrall that the Cass County Board of Commissioners remove former Commissioner Jeannette Stanton from its Social Services Board "without cause" as is provided under North Dakota Century Code 50-01-10 and that this resolution be prepared Wednesday, March 22, 1989, and sent the same day to the director of the North Dakota Department of Human Services for concurrence on or before March 31, 1989 so that this Commission can reappoint a new member at its will and sole discretion at its April 4, 1989 meeting. He provided Commissioners with copies of the February 14th minutes authorizing the Chairman to send letters by registered mail to former Commissioners Larson and Stanton requesting resignations from boards to which they were appointed at the time they were elected County Commissioners. The motion carried on roll call vote with three members voting "Aye", Mr. Eckert and Mr. Wieland opposing. 39.CO. COMMISSIONERS, Tenure of appointments Chairman Eckert asked the States Attorney if there are any boards or committees where former Commissioners' positions would not be terminated at the time they are no longer a County Commissioner. The States Attorney referred to a letter he wrote to the Commission dated January 6, 1989, regarding tenure of Commission appointments. 40.SOCIAL SERVICES, Joint resolution MOTION, passed Mr. Shannon moved and Mrs. Toussaint seconded that the States Attorney draft an appropriately stated joint resolution for the Chairman to sign and to be mailed on March 22nd to the State Human Services Department for removal of County Social Service Board Hember. Motion carried. 41.CO. COMMISSIONERS, Board membership, reconsider initial motion MOTION, passed Mr. Shannon moved and Mr. Sondrall seconded to reconsider the initial motion regarding former Commissioner Jeannette Stanton. Mr. Shannon stated that this would give Commissioners Eckert and Wieland an opportunity to rethink their vote. Motion carried.
