139 Assistant States Attorney Jim Twomey appeared before the Board stating that an election was held as ordered by the Board of Cass County Commissioners on the incorporation of Oxbow. County Auditor Ordelle Brua reported that there were 42 votes cast in favor of incorporation and one vote against incorporation, according to her canvass of the election results, the same results as submitted by the election officials. Mrs. Stanton moved and Mr. Larson seconded that the results of the canvass of the September 29, 1988, election for incorporation of Oxbow be entered in the Commission proceedings on this date. On roll call vote, the motion carried unanimously. Mr. Larson moved and Mrs. Stanton seconded to enter in the Commission proceedings on this date the following order declaring that the territory described in the petition be incorporated as a city with the name of Oxbow, as requested in said petition. On roll call vote, the motion carried unanimously. ORDER OF BOARD OF COUNTY COMMISSIONERS: The Board of County Commissioners of Cass County, North Dakota, having received from the election officials presiding over the election for incorporation held on September 29, 1988, an election return affidavit and verification showing the number of votes cast for incorporation to be in the number of forty-two (42), and the votes cast against the incorporation to be in the number of one (1), and having canvassed the said return; and the result of the canvass of the election having been entered in the minutes of the proceedings of the Board of County Commissioners; and it appearing that a majority of the votes cast at the election favored election; NOW, IT IS HEREBY ORDERED AS FOLLOWS: That the territory described in the petition be and is hereby declared to be incorporated as a city under the council form of government to be named the city of Oxbow which name was requested in the petition for incorporation. That a copy of this order shall be entered in the minutes of the proceedings of the Board of County Commissioners of Cass County, North Dakota, and a certified copy of the order shall be filed for record in the office of the Register of Deeds of Cass County and a certified copy of the order shall be filed in the office of Secretary of State as required by N.D.C.C. 40-02-12. Dated this 25th day of October, 1988. Costs of the election for the incorporation of Oxbow totaled $183.10 according to the County Auditor. Jim Twomey stated that the attorney on behalf of Oxbow expects that the city of Oxbow will reimburse Cass County for the election expenses. Upon the request of Gregory Selbo, Attorney for the Oxbow incorporation, Mrs. Stanton moved and Mr. Sondrall seconded to attach a legal description of the property to the Order for Incorporation prior to filing it with the Register of Deeds and the Secretary of State. Motion carried.
