A bid opening was scheduled at 10:00 ~.M. for election <br />supplies. Bids were received and opened from Knlght Printing <br />Company of Fargo for 1988 elections. Mrs. Stanton moved and Mr. <br />Nieland seconded to refer the bid to County Auditor Ordelle Brua for <br />evaluation and recommendation. Motion carried. <br /> <br /> ~t a bid openlng scheduled for 10:00 A.M. for the sale of four <br />County Road Department road graders, bids were received from the <br />following: <br /> <br />Butler Machinery Oompany, Fargo, ND <br />Marvin Peterson, Erhard, MN <br />Johnsons Motor Sales, New Richmond, WI <br />Red River Valley Fair, Nest Fargo, ND <br />Fargo Parts and Equipment, Fargo, ND <br />General Equipment & Supplies, Fargo, ND <br />Masters Construction, Fargo, ND <br /> <br /> Mr. Sondrall moved and Mr. Wieland seconded that Vouchers No. <br />81954 through No. 82318 be approved and ordered paid. On roll call <br />vote, the motion carried unanimously. <br /> <br /> An application for County Beer and Liquor License was submitted <br />by Attorney Terry L. Niles on behalf of PiG New Horizons, Inc., <br />d/b/a Lower 48 at Wild Rice, ND. Mr. Niles stated that he provided <br />copies of the application to the Cass County Sheriff's Office and to <br />the Cass County States Attorney's Office for a criminal records <br />check and recommendations. Mr. Niles was present, along with <br />corporation applicants Peter Nerner, Gary Marshall and Horace <br />Seixas. Mr. Niles stated that the present license expired <br />December 31, 1987, and he stated that he would like to see the <br />application approved as soon as possible because they must obtain a <br />local license before applying for a State license. Mrs. Stanton <br />stated that she would not vote in favor of issuing this license <br />without approval from the Sheriff's Office and States Attorney, and <br />she suggested placing the matter on the agenda for next week. <br />States Attorney Robert Hoy was present and expressed concerns that <br />the former corporation officers do not, in any way, become involved <br />again because of their criminal records. Mr. Niles stated that the <br />previous owners are not going to be involved in PiG New Horizons, <br />Inc., and he would be willing to make any statements or commitments <br />that the States Attorney would require. Mr. Hoy suggested that he <br />and the Sheriff's Office sit down with Mr. Niles to discuss the <br />concerns and draft the necessary language, and come back to the <br />Commission meeting before it is ad3ourned. <br /> <br /> Regarding an update on the tax increment error on two City of <br />Fargo pro3ects, States Attorney Robert Hoy stated that the statutes <br />do not provide for a specific remedy, but it appears that the only <br />viable solution would be a claim against the Oounty directly by the <br />entities involved. He stated that the County does have errors and <br />omissions insurance for the years 1984, 1985, 1986 and 1987. He has <br />spoken with legal counsel for the entities affected, and he believes <br />that the City of Fargo and the Fargo School District intend to seek <br />a claim against the County's insurance policy. The Chairman <br />suggested placing the matter on the agenda for next week. <br /> <br /> <br />
