<br />thereof in satisfactory condition and repair. TENANT acknowledges that no <br />representations or warranties as to the physical condition of the PROPERTY have been <br />made by or on behalf of NORDICK. TENANT acknowledges that no agreement or <br />promise to decorate, alter, repair or improve the PROPERTY has been made by or on <br />behalf of NORDICK except that NORDICK shall: <br /> <br />a. fix all existing light fixtures and replace bulbs as necessary; <br />b. remove 3 partition walls in the central office area; <br />c. replace suspended ceiling tiles as necessary; <br />d. patch and paint all office area walls; <br />e. remove all floor covering and replace with either epoxy paint or VCT <br />flooring in the office area and install vinyl base; <br />f. replace the seal on the bottom of the overhead door; <br />g. replace the bottom sweep on the warehouse service door and paint <br />the service door; <br />h. remove the steel netting under the warehouse mezzanine; <br />i. remove the lower shelf on the warehouse shelving on the wall adjacent <br />to the door to the office area; <br />j. patch but not paint the warehouse walls; and <br />k. clean the office and warehouse areas including the windows. <br /> <br />11. Alterations, Improvements, and Additions TENANT shall not make any <br />alterations, improvements or additions to the PROPERTY without prior written consent <br />of NORDICK. Such consent shall not be unreasonably withheld and all alterations, <br />improvements, additions, and replacements shall be and remain the property of <br />NORDICK upon expiration or earlier termination of this lease. TENANT shall promptly <br />pay for all work done and materials supplied in or about the PROPERTY and not suffer <br />or permit any lien to be asserted against the PROPERTY. <br /> <br />12. Repairs and Maintenance TENANT shall keep the PROPERTY in good <br />order and repair at TENANT's sole expense. If TENANT refuses or neglects to <br />commence or complete repairs promptly and adequately, NORDICK may make or <br />complete such repairs and TENANT shall pay the cost thereof to NORDICK. Except <br />that NORDICK shall be responsible for: <br /> <br />a) Maintaining the driveways and parking lot; <br />b) Repairing any failure of the building's structural system, floor slab, roof <br />and outside walls; <br />c) Repairing any failure of the underground sewer and water lines from <br />plumbing fixture to the City's services and replacement of any failed <br />plumbing fixtures; <br />d) Repairing any failure of the electrical system from the utility's service to <br />the fixture (but specifically excluding light bulbs or ballasts); <br />e) Replacement of any failed heating or air-conditioning units so long as that <br />failure did not result from TENANT's failure to maintain and properly <br />operate the heating or air-conditioning units. <br />
