<br />Commission Minutes--August 4, 2003 2627 <br /> <br />Resolution #2003-8 <br />Adoption of Cass County Multi-Jurisdiction, Multi-Hazard Mitigation Plan <br /> <br />On August 4,2003, the Cass County Commission adopted the Multi-Jurisdiction, Multi- <br />Hazard Mitigation Plan based on the following resolution: <br /> <br />By virtue of the authority vested in the Cass County Commission, we do hereby accept as a <br />planning guide the Cass County Multi-Jurisdiction, Multi-Hazard Mitigation Plan as part of <br />our long-term recovery strategy which promotes pre- and post-disaster mitigation measures <br />(e.g. hazards involving floods, winter storms, summer storms, hazardous materials, urban <br />and rural fires, drought, mass casualty incident, dam failures, shortage of critical materials, <br />civil disorder/terrorism, and national security). The overall intent of this plan is to identify <br />opportunities to reduce the impact of future disasters and emergencies. <br /> <br />7. GREENWAY PROPERTY, Farmland lease policy adopted <br />Keith Berndt, County Engineer, was present to discuss leases of farmland within greenway <br />property owned by the county. A subcommittee was formed consisting of Commissioner <br />Meyer, Commissioner Sorum, Tax Director Frank Klein and himself to develop a policy to <br />deal with this issue. Some of the major components of the policy include: farmland <br />purchased by the county may continue to be farmed if the county determines that is the <br />most appropriate use of the land; the previous owner has first refusal rights to rent the land <br />at fair market rental rates; if the current operator is not the owner, the county may allow the <br />operator to continue farming the land or may solicit bids; real estate taxes for the land will be <br />paid by the county; the lessee has the right to restrict access to the rented land; hunting and <br />motorized vehicles are not allowed except for lessee's vehicles; and subleasing is not <br />allowed. Mr. Berndt displayed a map of the greenway that showed previous structural and <br />lot buyouts, current high priority and medium-to-Iow priority properties. <br /> <br />The State's Attorney has one issue that needs to be reviewed, so Mr. Berndt is asking that <br />the policy be adopted subject upon the State's Attorney's concurrence with the policy. <br />MOTION, passed <br />Mr. Meyer moved and Mr. Bennett seconded to adopt the proposed policy <br />on leasing of county-owned property as recommended by the <br />subcommittee appointed by the County Commission contingent upon <br />State's Attorney concurrence with the policy. Discussion: Mr. Bennett <br />asked if bow hunting would be allowed. Mr. Berndt said there should be <br />some areas that would be appropriate for bow hunting enthusiasts. Mr. <br />Wagner was concerned about establishing an equitable rental rate. Mr. <br />Berndt said an outside land management firm would provide an <br />assessment and make a recommendation on the rate, which would be <br />included in the lease. Each lease would be approved by the commission. <br />Mr. Burdick said the issue he has a question on should be resolved in <br />the next few days. On roll call vote, the motion carried unanimously. <br /> <br />8. VOUCHERS, Approved <br />MOTION, passed <br />Mr. Vanyo moved and Mr. Meyer seconded to approve Voucher No. <br />179,085 through No. 179,425. On roll call vote, the motion carried <br />unanimously. <br />
