<br />Commission Minutes--February 18, 2003 2564 <br /> <br />,,- <br /> <br />Mrs. Sorum seconded the motion, saying she believes the board left all <br />the options open and it comes to a budget issue. She said the board <br />considered Mr. Paaverud's recommendation to utilize the sheriff's <br />residence, which was in itself a recommendation, and the attorney and <br />state's attorney have advised that the county would not be in violation of <br />the century code by awarding demolition bids. <br /> <br />"" <br /> <br />Discussion on the motion: <br />Mr. Vanyo prepared an extensive written document outlining his <br />observations on this topic starting about one year ago, when he was <br />contemplating running for the office of county commissioner. He <br />believes proper planning has taken place in the past and will continue in <br />the future. He believes there is a critical need to act today because of the <br />favorable demolition bids and because months of additional planning are <br />necessary in order to know which alternatives will be used for future <br />expansion. He said photographs and salvaged materials from the former <br />jail and sheriff's residence could do a lot to preserve history, while <br />allowing the county to exercise fiscal responsibility in meeting its space <br />needs for the future. Therefore, he supports the motion to award bids for <br />demolition of both structures. (A copy of Mr. Vanyo's written comments <br />will be attached to the official minutes of today's meeting). <br />Mr. Bennett echoed Mr. Vanyo's remarks and said he was determined to <br />find out if the sheriff's residence could be saved; however, he will <br />support the motion today to demolish both buildings. He believes all five <br />commissioners have reached the same conclusion and said the <br />preservation should be in the form of a written history of the buildings <br />and doing a good job with photographs and salvaging the items that <br />have been specified. <br />At the call for the question and on roll call vote, the motion carried <br />unanimously. <br /> <br />Mr. Wagner said it is important to understand the county has taken every aspect of this very <br />seriously. He said this is a local issue, these buildings are owned locally, and North Dakota <br />Century Code 11-11-14, Powers of Board of County Commissioners, includes the control of <br />property of the county. Further, he said the Cass County Home Rule Charter includes a <br />provision of initiative and referendum for the electors of Cass County, if individuals disagree <br />with a decision of the board. <br /> <br />Mr. Bennett commented that he felt no pressure from any member of the board of <br />commissioners to try to sway his vote on the issue, and he appreciates that. <br /> <br />15. VOUCHERS, Approved <br />MOTION, passed <br />Mr. Meyer moved and Mrs. Sorum seconded to approve Voucher No. <br />173,327 through No. 173,868.
