An application for Anhydrous Ammonia License from the State of <br />North Dakota was presented by R.F. "Ron" Dalbey, General Manager of <br />the Peavey Company of Davenport /Durbin, ND. He received a special -use <br />permit from Durbin Township for the Peavey Company to install the <br />facility in the Village of Durbin, and he is now requesting permission <br />from Cass County prior to submitting the application to the State <br />Department of Agriculture for final approval. The States Attorney <br />stated that there is a special chapter of the North Dakota Century <br />Code dealing with anhydrous ammonia facilities requiring a county <br />license and a State license as of June 30, 1985. He cited reasons <br />that the county board may deny the license, one being for failure <br />to comply with local citing requirements. Gerald Moderow, a <br />representative of the Durbin Township Board, was present and stated <br />that the requirements of the Township Board have all been met. <br />Mr. Eckert stated that the condition of County Road 9 in this <br />area is very much a concern, and he suggested that the Peavey Company <br />consider an alternative site. He stated that the road in this area <br />has been a burden on the County from the unit train, and this will <br />be an additional burden. Mr. Dalbey stated that a majority of the <br />product will be delivered by rail, but Mr. Eckert stated that rail <br />service is not as fast and they will also be delivering by semi-trucks <br />in the spring when the product is used the most. <br />Mr. Wieland stated that it was a disappointment to the County <br />when the unit -train began operation in this area without the <br />Commission's prior knowledge as it does cause problems on the roads. <br />When the condition of County Road 9 weakens, it will not be a priority <br />for repair, due to other priorities and the condition of other roads <br />in the County. County Engineer Don Richards stated that the road <br />has a low weight limit, and Mr. Dalbey has talked to him about this. <br />Mr. Larson moved and Mrs. Stanton seconded that the Chairman <br />be authorized to sign the Application for Anhydrous Ammonia License <br />for the Peavey Company in the village of Durbin according to their <br />application of August 27, 1986. The motion carried on roll call vote <br />with four members voting "Aye Mr. Eckert opposing. <br />Mrs. Stanton moved and Mr. Eckert seconded that the County <br />Engineer and members of his staff be authorized out of state travel <br />to attend aworkshop on computers in St. Cloud, Minnesota, on September <br />8 and 9, 1986. On roll call vote, the motion carried unanimously. <br />Mr. Larson moved and Mr. Sondrall seconded that Vouchers No. <br />66,823 through No. 67,678 be approved and ordered paid. On roll call <br />vote, the motion carried unanimously. <br />Mr. Sondrall moved and Mr. Larson seconded to accept the <br />resignation of Cass County Planning Commissioner Victor Knudson with <br />regrets, and to request him to serve on a three member advisory board. <br />Motion carried unanimously. <br />
