I further undemtand that he meant to submit the resolution <br />pumuant to Article 3 of Cass County's Home Rule Charter. <br /> <br />As a point of reference, the Commission on May, 7, 2001, approved an <br />approach on the old Jail and Sheriffs Residence which is not <br />consistent with the resolution. That approach is described in the <br />related meeting notes which are attached to this letter. <br /> <br />At the verbal request of a commissioner I am providing written <br />comments on certain legal aspects of the proposed resolution. I first <br />discuss the background and conclude with my opinion of the <br />procedural posture of the resolution. <br /> <br />General Background on County Powers <br /> <br />The North Dakota Legislature has established laws governing county <br />government in North Dakota CentuP/Code (NDCC) Chapter 11 - <br />Counties. In particular, NDCC Chapter 11-09.1 governs home rule <br />charter counties. Specifically, NDCC Section 11-09A-05 outlines the <br />powers available to home rule charter counties. <br /> <br />In 1994 Cass County adopted and implemented a Home Rule Charter <br />(HRC).
