<br />Commission Minutes--May 16, 2005 <br /> <br />2901 <br /> <br />MOTION, passed <br />Mr. Pawluk moved and Mr. Wagner seconded to award the low bids for <br />the Cass County vector building to Lee Jones & Son, to Peterson <br />Mechanical, and to Charlie & Sons Electric. On roll call vote, the motion <br />carried with three members voting "Aye" and Mrs. Sorum opposing. <br /> <br />16. RESOLUTION #2005-13, Second readin~/adoption of resolution on alcoholic bevera~e <br />After receiving a request from Rodney Hogen of Buffalo, Mr. Burdick said the commission <br />had discussed procedural changes to allow for the sale of wine under the beer license, <br />without having to obtain a county liquor license. The board had also discussed enacting an <br />ordinance for this purpose; and Mr. Burdick said that could be done at a later date, if <br />needed. <br /> <br />Today is the date advertised for second reading and adoption of a resolution to modify <br />county policy covering the sale and distribution of alcoholic beverages in Cass County. First <br />reading of the resolution was held on April 18, 2005. <br /> <br />Tracy Peters, Assistant State's Attorney, reviewed statutes and procedures concerning the <br />sale of alcoholic beverages, as well as the domestic winery license obtained from the State <br />Tax Department. She said Mr. Hogen would be considered a retailer and does not fit the <br />description for a domestic winery because wine is not produced on his property. Mr. Hogen <br />has a vineyard where he is growing grapes, and he will have a building for wine tasting and <br />selling. He also intends to sell beer. Mr. Hogen was present and said the wine he plans to <br />sell will be from a winery in Casselton, and he will also purchase wine from other locations. <br /> <br />Ms. Peters said changing the county policy, as discussed by the board on April 18th, would <br />allow Mr. Hogen to sell beer and wine at his vineyard for the annual license fee of $100. <br />Mr. Pawluk feels the county license fee is low, even for a liquor license at $1,000 per year, <br />because of increased law enforcement and administrative costs for issuing licenses. Mr. <br />Wagner said the board may wish to look at the alcoholic beverage license fee structure at <br />another time, such as during county budgeting. <br />MOTION, passed <br />Mrs. Sorum moved and Mr. Wagner seconded to approve the second <br />reading and adopt Resolution #2005-13 amending the Procedure for <br />Obtaining a County Beer/Liquor License by changing the word "liquor" <br />to "alcoholic beverage" and setting the fee for a beer and/or wine license <br />in the amount of $100; and to approve the request of Rodney Hogen d/b/a <br />The Vineyard LLC, Buffalo, North Dakota, for a county beer and wine <br />license at a cost of $100 for 2005; plus an additional $75 for Sunday <br />openings from May 29 through September 4, 2005. On roll call vote, the <br />motion carried unanimously. <br /> <br />17. VOUCHERS, Approved <br />MOTION, passed <br />Mr. Pawluk moved and Mr. Wagner seconded to approve Voucher No. <br />197,170 through No. 197,810. On roll call vote, the motion carried <br />unanimously. <br />
