<br />Commission Minutes-May 2, 2005 2894 <br /> <br />14. ORDINANCE #1997-3 AMENDED, Second reading/adoption, county park campsites <br />For second reading of the amended ordinance establishing fees for the use of electricity and <br />water at the Brewer Lake campground, Mr. Burdick said the ordinance also adds a fee to <br />obtain a permit for group activities involving more than 25 people. Fireworks, model rocket <br />engines, combustible or explosive materials are prohibited; and the use of firearms is also <br />prohibited. Among some other regulations, the ordinance includes language that the park <br />will have a curfew of 11 :30 PM. No unnecessary noise, driving or consumption of alcohol <br />will be permitted after 11 :30 PM. <br /> <br />Mr. Vanyo said one outstanding item is modifying the period of time that a campsite may be <br />occupied from ten consecutive days to 30 days. Mr. Montplaisir said State park regulations <br />call for a maximum stay of 10 consecutive days; however, he received a telephone call from <br />an official from the North Dakota Game and Fish Department's Jamestown office indicating <br />the county could make that determination given the lease Cass County has on the Brewer <br />Lake property. <br /> <br />Mr. Montplaisir said he received a telephone call from a potential camp host for Brewer <br />Lake; however, he has learned there is no water and electricity to the campsites for the <br />recreational vehicles. He contacted the County Park Board Chairman, Chad Peterson, who <br />will obtain cost estimates. Mr. Vanyo said the park board may need to meet in that regard. <br />MOTION, passed <br />Mr. Pawluk moved and Mr. Wagner seconded to adopt the Amended <br />Ordinance #1997-3 regulating and restricting the use of Cass County <br />park campsites. Discussion: Mr. Bennett asked if the ordinance is clear <br />enough on the curfew and prohibiting unnecessary noise and the <br />consumption of alcohol after 11 :30 PM. Others believe it is clear the way <br />it is written. On roll call vote, the motion carried unanimously. <br /> <br />15. RED RIVER VALLEY FAIR/COUNTY CAMPGROUND, Transfer of campsite <br />Commissioners received a letter from Mr. Burdick dated April 25, 2005, enclosing copies of <br />a letter from the National Park Service and the North Dakota Parks & Recreation approving <br />termination of the Land and Water Conservation Fund compliance responsibilities from the <br />campground project at the Red River Valley Fairgrounds. Therefore, the county may <br />transfer the property to the Red River Valley Fair Association, as requested by their <br />attorney, Jonathan Garaas. For background history on the campground, Mr. Burdick's letter <br />suggests referring to the materials presented for the March 21, 2005 commission meeting. <br />MOTION, passed <br />Mrs. Sorum moved and Mr. Bennett seconded to approve the transfer of <br />the Cass County campsite near the fairgrounds to the Red River Valley <br />Fair Association, and authorize the commission chairman to sign an <br />appropriate deed. On roll call vote, the motion carried unanimously. <br /> <br />16. ROAD DEPARTMENT, Kindred Truck Route <br />Mr. Berndt presented additional information in a memorandum dated today regarding the <br />funding request for a Kindred truck route. He recommends support of the City of Kindred's <br />request to add their truck route to the County Federal Aid System, with the following <br />conditions: 1) City receives $200,000 in Federal Aid and constructs improvements not later <br />than September 2006; 2) City agrees to enter into maintenance agreement with the county <br />to pay all maintenance costs; 3) City is responsible for any necessary right of way <br />acquisition; 4) City to maintain road to all required Federal Aid System and county <br />
