<br />Commission Minutes-May 2, 2005 2893 <br /> <br />Mr. Vanyo asked Mr. King about the computations prepared by the City of Fargo in a report <br />dated February 28,2005 to the Board of Fargo City Commissioners. Mr. King replied that <br />he had not seen the report and could not analyze it at this time. He said someone else in <br />his office was originally handling this case. <br /> <br />Mr. Klein said he requested more detailed information last month from the property tax <br />representative on the rental history and a sales analysis of both properties. He did not get a <br />response, other than receiving the same information that had already been provided. <br />MOTION, passed <br />Mr. Pawluk moved and Mr. Wagner seconded that the requests for <br />abatement #4230 and #4231 be denied, as recommended by the City of <br />Fargo and the Director of Equalization. On roll call vote, the motion <br />carried unanimously. <br /> <br />13. ORDINANCE #2005- 2, Second readinaladoption, over-dimension vehicle reaulations <br />Keith Berndt, County Engineer, was present for the second reading of a proposed ordinance <br />to regulate vehicle dimensions and weights on Cass County Highways. The ordinance <br />allows for issuance of special permits/fees, by the county highway department or sheriff's <br />department, for vehicles of excessive size and weight traveling upon a highway under the <br />jurisdiction of Cass County. Mr. Berndt recommends the board approve the ordinance and <br />policy for over-dimension vehicle regulations, and that he would be authorized to make the <br />appropriate correction to the tandem axle chart in the proposed policy. <br /> <br />Mr. Bennett said the policy indicates permits will not be issued Saturdays, Sundays or <br />holidays, and he asked if a sheriff's patrol deputy could issue permits in certain situations. <br />Mr. Berndt said this language was included in the policy because of Monday - Friday office <br />hours; however, he has talked to the Sheriff's Department and they would concur if it is on <br />an exception basis. Mr. Berndt said he would not be opposed to the commission omitting <br />the language pertaining to obtaining permits on weekends and holidays. <br /> <br />Birch Burdick, State's Attorney, said the county commission has approved a court services <br />agreement whereby the East Central Judicial District Court would hear and determine <br />actions and proceedings concerning the enforcement of county home rule ordinances. The <br />fines and costs will be collected by the Clerk of District Court, with the court retaining 60% <br />and the county receiving 40% of all amounts collected. However, in the case of the over- <br />dimension vehicle ordinance, an exception to the agreement entitles Cass County to receive <br />100% of the fees, fines and other monetary consideration collected. Mr. Burdick said the <br />presiding judge, Georgia Dawson, has signed the agreement and it is now with the State <br />Court Administrator to sign. <br />MOTION, passed <br />Mr. Bennett moved and Mrs. Sorum seconded to adopt Ordinance #2005- <br />2 and related county policy to regulate vehicle dimensions and weights <br />on Cass County highways; with the understanding that the county <br />engineer will work with the sheriff's department on issuing permits other <br />than during office hours; and authorizing the county engineer to make <br />the appropriate correction to the tandem axle chart, as mentioned above. <br />On roll call vote, the motion carried unanimously. <br />
