On roll call vote, the motion carried unanimously. 7. CONTRACT APPROVAL, Official Payments CorD.: Hazardous Material; North Dakota Highwav Patrol; Juvenile Crime Enforcement Coalition: DeDartment of TransDortation MOTION, passed Mr. Wieland moved and Mrs. Schneider seconded to approve the following contracts submitted by respective department heads, subject to state's attorney approval, and authorize the chairman to sign: On roll call vote, the motion carried unanimously. Official Payments Corporation--credit card payment services; City of Fargo--Hazardous Spill Containment Agreement; North Dakota Highway Patrol--traffic safety grant for fiscal year 2001-2002 and related budget adjustment; Juvenile Accountability Incentive Block Grant (JAIBG)--Cass County Juvenile Crime Enforcement Coalition; North Dakota Department of Transportation--traffic safety enforcement and related budget adjustments. 8. MIDA BOND HEARING RESCHEDULED, American Lutheran Homes Legal publication requirements were not met in order to hold the MIDA Bond hearing today for the American Lutheran Homes, Inc. Kinder Apartments Project. Therefore, the public hearing and proposed resolution are rescheduled fortheAugust20, 2001, County Commission meeting. 9. CEMETERY DRAINAGE, County assists in costof drainaae involvina SDrinavale Cemetery At Commissioner Wagner's request, Michael Montplaisir, County Auditor, explained a drainage situation at Springvale Cemetery as it relates to dirt work at Beth EI Memorial Park. Originally, the drain in Beth EI was going to be filled in and routed another direction by Beth EI Memorial Park. This would have created problems for both Holy Cross and Springvale Cemeteries, according to Mr. Montplaisir, who reviewed the situation last spring with Mr. Wagner and the County Engineer, Keith Berndt. Since Springvale Cemetery did not have a problem with drainage before, the county representatives wanted to be sure there would not be a problem after the dirt work at Beth EI. In a letter to the County Auditor last spring, Jerome D. Feder, Chairman of Beth EI Memorial Park, asked the county to pay one-half of the $7,315.00 cost of dirt work because the project design was changed to include a culvert so the water from Springvale and Holy Cross would still drain through Beth EI. Mr. Wagner placed this item on the agenda for the Board's consideration today, as he believes the county should make a financial contribution to the project. However, he thought 50% was too high since the majority of benefit goes to Beth EI Memorial Park and since drainage was not a problem at Springvale before.
