On <br />roll call vote, the motion carried unanimously. <br /> <br />CONTRACT APPROVAL, Brezina Construction ComDanv: Mark Sand and Gravel: Farao <br />Cass County Economic DeveloDment CorDoration: All-Terrain Grounds Maintenance <br />MOTION, passed <br />Mr. Wagner moved and Mrs. Schneider seconded to approve the <br />following contracts submitted by respective department head, subject <br />to state's attorney approval, and authorize the chairman to sign: On <br />roll call vote, motion carried unanimously. <br /> <br />Brezina Construction Company--precast concrete box culvert on County Highway 10 in <br />the amount of $111,954.60; <br />Mark Sand and Gravel--bituminous surfacing of County Highways 20, 5, 6 and 19 in the <br />amount of $1 ,991 ,588.62; <br />Fargo Cass County Economic Development Corporation--2001 contract for services; <br />All-Terrain Grounds Maintenance--Iawn care at Springvale Cemetery. <br /> <br />STREET IMPROVEMENT DISTRICT NO. 2001-1, Delaved until Mav 7 Commission meetina <br />A request from the Westwood Homeowners Association (Holmen's Third Subdivision) to create <br />a street improvement district will be rescheduled on the May 7th Commission agenda, as <br />requested by Attorney Daniel Twichell. Additional signatures are required before the county <br />considers the project. <br /> <br />17 . TAX PENALTY AND INTEREST, David Habiaer invited to attend Commission meetina/did <br />not aDDear before the board <br />Commissioners received a letter from David Habiger, dated March 14, 2001, regarding penalty <br />and interest which accrued when he did not pay his property taxes. Chairman John Meyer sent <br />a letter to Mr. Habiger informing him that he was scheduled on today's agenda to discuss <br />penalty and interest on his taxes. The Chairman said the record should reflect that Mr. Habiger <br />was not present, and no one was present representing him. <br /> <br />18. WATER RESOURCE DISTRICT, Rush River maintenance assessment district <br />William Thompson, Chairman of the Rush River Water Resource District (WRD), was present <br />along with other board members, Ray Wolfer and William Hejl, as well as Engineer Jeff Volk <br />and Attorney Steve McCullough, requesting the county commission to approve a Rush River <br />maintenance assessment district. <br /> <br />Mr. Thompson said the Rush River WRD general mill levy is insufficient to continue funding <br />maintenance costs on projects constructed in the 1950's and 1970's, and the North Dakota <br />Century Code allows for the creation of a maintenance district with a two-thirds vote of the <br />Water Resource District Managers and a two-thirds vote of the Cass County Commission. <br /> <br />Mr. Volk distributed maps to commissioners of the proposed assessment district, and he <br />provided a tabulated list entitled "Rush River Channel Improvements Maintenance Assessment <br />District" which includes parcel numbers, legal description of each property, taxable value, <br />benefit factor and maximum annual levy for each piece of property. <br />
