<br />Commission Minutes--ApriI17, 2000 2115 <br /> <br />Whereas, The Board of County Commissioners has been unable to purchase the land <br />required at a price which the Board deems reasonable; and <br /> <br />Whereas, 24-05-09 and 24-05-10 of the North Dakota Century Code authorize the Board of <br />Commissioners to purchase, acquire, take over, or condemn under the right and <br />power of eminent domain, for such county, any and all lands which it deems <br />necessary for improving any highway. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Cass County Board of Commissioners that <br />taking of the land in Section 18 of Reed Township as described by the County Engineer is <br />hereby declared a pubic necessity. A special board consisting of the County Auditor, the <br />County Treasurer, and the County Register of Deeds shall fix the damages for the taking. <br /> <br />Dated at Fargo, North Dakota this 17th day of April, 2000. <br /> <br />16. HIGHWAY DEPARTMENT CONTRACTS, Surd & Smith Construction. Inc.: Border States <br />Paving: Jensen Bros. Inc.: Border States Paving: Wanzek Construction <br />Mr. Koenig asked to move these contracts to the regular agenda for discussion today since the <br />County Road Advisory Committee recommended delaying approval at their last meeting held <br />April 3, 2000, pending bid results of County Highway 81 reconstruction and bridge replacement. <br />According to correspondence from Mr. Berndt, bid results for the Highway 81 projects are close <br />enough to the engineer's estimates that he recommends proceeding with both projects, as well <br />as the three projects that were delayed from the last meeting. Mr. Wieland said he was in <br />Bismarck last Thursday and was informed by the North Dakota Department of Transportation <br />that bids on road projects have been quite favorable throughout the State. <br />MOTION, passed <br />Mr. Koenig moved and Mrs. Quick seconded to approve the following <br />contracts submitted by respective department head and portfolio <br />commissioner, subjectto state's attorney approval; and authorize the <br />chairman to sign: On roll call vote, motion carried unanimously. <br /> <br />Burd & Smith Construction, Inc.--County Highway 10 realignment, grading, bituminous surfacing <br />and incidentals in the amount of $162,604.25; <br />Border States Paving--County Highway 31 bituminous surfacing in the amount of $488,887.51; <br />Jensen Bros., Inc.--County Highway 20 grading in the amount of $263,793.58; <br />Border States Paving--resolution and contract documents when available accepting the bid for <br />County Highway 81 reconstruction; <br />Wanzek Construction Inc.--resolution and contract documents when available accepting the bid <br />for County Highway 81 Wild Rice River Bridge replacement project. <br /> <br />17. BUDGET AMENDMENT, Position authorization request to share Accountant I between <br />County Auditor's Office and Highway Department <br />A letter was received from the County Auditor dated April 7, 2000, concerning a proposal to <br />share an Accountant I position between the County Engineer's and Auditor's Offices, due to the <br />recent resignation of the Highway Department accounting supervisor, Leland Johnson. <br /> <br />Mr. Montplaisir said the Highway Department has a need for professional accounting services, <br />but probably not on a full-time basis.
