<br />Commission Minutes--March 21,2005 2877 <br /> <br />MOTION, passed <br />Mr. Bennett moved and Mrs. Sorum seconded to enter into a contract <br />with Foss Associates for the construction of two additional 48-bed <br />housing pods; to appoint County Coordinator Bonnie Johnson as the <br />project coordinator, and solicit bids for the work. Cass County would <br />retain the right to reject any or all bids at the time of the opening of the <br />bids. On roll call vote, the motion carried unanimously. <br /> <br />13. ORDINANCE #2005- , First readinQ for truck size limits and permit policies <br />Mr. Berndt proposed first reading today of a draft ordinance and policy regarding legal size <br />limits and permit policies for over-dimension vehicles traveling on Cass County highways. <br />The ordinance and policies were discussed in detail at a meeting of the Cass County Road <br />Advisory Committee held earlier today and were approved for forwarding to the county <br />commission. <br /> <br />The ordinance and associated policy are intended to preserve county highways by providing <br />better overweight enforcement, to promote more economical movement of goods by <br />allowing properly configured vehicle combinations to exceed current weight and length <br />limitations, to allow the county to retain revenue from oversized vehicle fines, to implement a <br />more formal permit system for vehicles that exceed the new legal limits and set charges for <br />the permits, and to implement a 10% over-weight allowance permit system during the winter <br />months when roads are able to accommodate heavier loads due to frozen sub-grades. <br /> <br />A representative of the North Dakota Highway Patrol was present, as well as Assistant <br />State's Attorney Leah Viste, who assisted in the ordinance process. <br />MOTION, passed <br />Mr. Wagner moved and Mr. Pawluk seconded to hold the first reading of <br />the Over-Dimensional Vehicle Ordinance and direct that the appropriate <br />notice be published and schedule a second reading of the ordinance for <br />May 2,2005. Discussion: Mr. Bennett asked Mr. Berndt to review the <br />following items: consider not requiring a permit for the winter season, to <br />report back to the board on the effectiveness of portable scales, <br />consideration for loads with added weight from mud and snow, and <br />consider whether or not fees for overweight vehicles are too high. On <br />roll call vote, the motion carried unanimously. <br /> <br />14. RED RIVER VALLEY FAIR/COUNTY CAMPGROUND, Discussion on aQreement <br />Mr. Burdick reported that he contacted the North Dakota Parks and Recreation Department <br />by telephone and has provided copies of documents concerning the campground at the Red <br />River Valley Fairgrounds. The county has been approached by the attorney for the Red <br />River Valley Fair Association, Jonathan Garaas, about deeding the campgrounds to the fair <br />association according to a prior agreement. <br /> <br />Since the campground was built with grant funds, the North Dakota Parks and Recreation <br />Department will contact the National Park Service to seek approval for the county to deed <br />the campground to the Red River Valley Fair Association. Mr. Burdick said the county has <br />been advised to wait for that approval before taking any action to deed the property; and he <br />suggested putting this item back on the commission agenda for the first meeting in May. <br />
