<br />Commission Minutes--March 21, 2005 2878 <br /> <br />15. STATE'S ATTORNEY UPDATE, Court Services AQreementlCounty Ordinances <br />Mr. Burdick presented a draft "Court Services Agreement" from the District Court Presiding <br />Judge, Georgia Dawson, for the enforcement of county ordinances through District Court. <br />The number and type of county ordinances are increasing, and Mr. Burdick believes it is <br />time to formalize an agreement with the court. The draft agreement he submitted for today's <br />meeting contains terms similar to those incorporated into other agreements with home rule <br />counties and municipalities in the state. <br /> <br />A number of provisions in the draft agreement have financial implications, according to Mr. <br />Burdick, such as the county paying any indigent defense costs that may arise, the county <br />paying for transcripts that may be required, and the county to receive 40% with the court <br />receiving 60% of any amounts collected. Mr. Burdick, however, is proposing that Cass <br />County be entitled to 100% of the fees, fines, costs, forfeitures and any other monetary <br />consideration collected from cases relating to any ordinance it may enact relating to <br />overweight vehicles. The reason for this exception is because the county would want this <br />money to help support the enforcement efforts of overweight vehicles traveling on county <br />highways. <br />MOTION, passed <br />Mr. Pawluk moved and Mr. Wagner seconded to approve a court <br />services agreement, as modified by the State's Attorney, Birch <br />Burdick. On roll call vote, the motion carried unanimously. <br /> <br />16. VOUCHERS, Approved <br />MOTION, passed <br />Mr. Bennett moved and Mrs. Sorum seconded to approve Voucher No. <br />195,761 through Voucher No. 196,155. On roll call vote, the motion <br />carried unanimously. <br /> <br />17. ELECTION EQUIPMENT; COURTHOUSE SECURITY; VECTOR BUILDING BIDS; <br />TOWNSHIP OFFICERS' ASSOCIATION MEETING, Committee reports <br />Michael Montplaisir, County Auditor, said election equipment for handicapped voters will be <br />demonstrated Tuesday at New Horizons Manor and Wednesday at the State Legislature. <br /> <br />Mrs. Johnson said the security plan is being reviewed by county departments in light of the <br />recent courthouse shootings in Atlanta, Georgia, to determine if any changes are needed. <br /> <br />Bid opening on a new vector control facility is scheduled for April 4, 2005, and Mrs. Johnson <br />said Keith Berndt is serving as the project coordinator. <br /> <br />Mr. Vanyo reminded commissioners of the annual spring meeting of the Cass County <br />Township Officers' Association to be h~ld on March 31,2005. <br /> <br />18. CORRESPONDENCE, Received and filed <br />MOTION, passed <br />Mrs. Sorum moved and Mr. Wagner seconded to receive and file <br />correspondence outlined by the secretary as follows: Motion carried. <br /> <br />North Dakota Department of Transportation information on additional Federal Aid <br />available in 2006 and 2007; <br />
