<br />CASS COUNTY <br />COMMISSION POLICY MANUAL <br /> <br />38. <br /> <br />SUBJECT: ORDINANCE #2005-_ (BOW HUNTING ON COUNTY PROPERTY) <br /> <br />ADOPTED DATE: <br /> <br />,2005 <br /> <br />PAGE 1 OF <br /> <br />PURPOSE: <br /> <br />It is the purpose of this Ordinance to provide an opportunity for bow hunting for deer on <br />selected property owned by Cass County Government. This Ordinance is intended to <br />provide a limited exception to the Cass County Commission Policy 37.10 prohibiting <br />hunting on county-owned hazard mitigation properties. <br /> <br />PROVISIONS: <br /> <br />1 . Application of State and local laws: All laws and regulations established by the <br />State of North Dakota and Cass County shall be enforced in hunting areas, <br />except those laws and regulations that by their nature are not applicable. <br /> <br />2. Game: The only game that may be hunted under this Ordinance are deer. <br /> <br />3. Specified Property for bow hunting: Bow hunting only shall be allowed only on <br />that portion of the Forest River Subdivision owned Cass County Government, as <br />more fully reflected on the Hunting Map available from the Cass County Sheriff. <br />Hunting is not allowed on any other Cass County Government property. <br /> <br />4. Trespass Permit Required: No one may hunt on the specified property without <br />obtaining a Trespass Permit. The Trespass Permit will authorize the archer to <br />hunt on the specified property only during specific time periods. The archer must <br />carry the Trespass Permit on their person while hunting. The archer must <br />display the Trespass Permit upon demand of any enforcement officer of the <br />State of North Dakota or Cass County. A valid North Dakota hunting license and <br />archery stamp is a prerequisite to obtaining a Trespass Permit. <br /> <br />5. Obtaining Trespass Permit: An eligible archer may apply for a Trespass Permit <br />with the Cass County Sheriff. The Cass County Sheriff shall select the <br />individuals to receive a Trespass Permit through a random drawing. Only ten <br />(10) Trespass Permits will be issued for the 2005 and 2006 hunting seasons. <br />The deadline for applying for a Trespass Permit for the 2005 hunting season <br />shall be August 1, 2005, and for the 2006 hunting season shall by August 1, <br />2006. <br /> <br />" <br /> <br />6. Hunting season: Archers may hunt during the entire regular bow season, as <br />established by the State of North Dakota, unless otherwise designated by the <br />
