<br />Commission Minutes--February 7,2005 2856 <br /> <br />North Dakota Department of Transportation--right of way certificate, <br />construction and maintenance agreement for bituminous overlay on <br />County Highway 81 from State Highway 46 north 6.33 miles; <br />North Dakota Department of Transportation--right of way certificate, <br />construction and maintenance agreement for bridge replacement on the <br />Sheyenne River two miles north of Horace; <br />Joint Powers Agreement--City of Fargo, Cass County and the Housing <br />and Redevelopment Authority of the City of Fargo to install and operate <br />an electrical generator being furnished by the Department of Homeland <br />Security on the Housing and Redevelopment Authority's property at 101 <br />2nd Street South in Fargo. <br /> <br />13. RESOLUTIONS #2005-3,2005-4,2005-5,2005-6,2005-7 and 2005-8 FOR STREET <br />IMPROVEMENT (GREYHAWK'S), Adopted subiect to State's Attornev review <br />Attorney Dan Twichell was present to request an amendment to Street Improvement District <br />#2004-1 for the purpose of aaphalt surfacing 64th Avenue South from 900 feet east of <br />County Road 17 to the entrance of Greyhawk Subdivision. He said the number of <br />signatures on the petition to amend the district is sufficient to meet statutory requirements. <br /> <br />Keith Berndt, County Engineer, said he reviewed the plans and specifications and <br />recommends approval of the street improvement district, although he noted the streets in <br />some areas will be narrow and the amount of right of way is less than may be needed at <br />some future date. He said the Stanley Township Board of Supervisors did not feel it was <br />essential for the residents to purchase additional right of way, at an estimated cost of <br />$100,000, at this point in time. <br /> <br />Questions were raised about the slope of the ditches and responsibility for not following a <br />particular standard. Mr. Berndt said he believes a two-lane road could serve for 20 years; <br />however, it could be five years, depending upon the pace of future development. Mrs. <br />Sorum said residents in this area have waited a long time for the improvements. <br />MOTION, passed <br />Mrs. Sorum moved and Mr. Wagner seconded to approve Resolution <br />#2005-3 Amending Street Improvement District #2004-1; Resolution <br />#2005-4 Directing Engineer to Prepare Amended Report; Resolution <br />#2005-5 Approving Engineer's Amended Report; Resolution #2005-6 <br />Directing Engineer to Prepare Amended Plans and Specifications; <br />Resolution #2005-7 Approving Plans and Specifications for <br />Improvements in Street Improvement District #2004-1; and Resolution <br />#2005-8 Directing Auditor to Advertise for Bids. Discussion: Mr. Pawluk <br />was concerned about lowering the standard for 64th Avenue South and <br />asked if the State's Attorney has reviewed the information presented to <br />the board before the county makes a commitment on the project. Birch <br />Burdick, State's Attorney said he reviewed the information as presented <br />to the commission, and he would be willing to discuss it with Mr. Berndt <br />in more detail, and to involve Mr. Pawluk in the discussion. Mrs. Sorum <br />added to her motion and Mr. Wagner agreed as the person seconding the <br />motion to approve the resolutions subject to the State's Attorney's <br />review. On roll call vote, the motion carried unanimously. <br /> <br />- <br />
