Commission Minutes--December 20, 2004 2840 MOTION, passed Mr. Wagner moved and Mr. Pawluk seconded to close the meeting at 4:30 PM for the purpose of discussing pending civil litigation and adversarial administrative proceedings based on North Dakota Century Code 44-04-19.1, the exceptions allowed for attorney consultation and/or negotiation. The topic to be discussed is the North Dakota Department of Agriculture v. Cass County. On roll call vote, the motion carried unanimously. The doors to the Commission Room were closed at this time; and those present in the room were Commissioners Bennett, Sorum, Vanyo, Wagner and Pawluk, State's Attorney Birch Burdick, County Auditor Michael Montplaisir, County Coordinator Bonnie Johnson, County Engineer Keith Berndt, and Administrative Assistant Joyce Schepp. 26. EXECUTIVE SESSION ADJOURNED, Reconvene reaular meetina MOTION, passed Mr. Pawluk moved and Mr. Wagner seconded to adjourn the executive meeting at 5:16 PM. Motion carried. Mr. Burdick noted that the doors to the Commission Room were opened at this time, and all five commissioners were present. 27. NORTH DAKOTA DEPARTMENT OF AGRICULTURE, Stipulation and consent aareement MOTION, passed Mr. Pawluk moved and Mr. Bennett seconded to authorize settlement with the North Dakota Department of Agriculture for the payment of $3,375.00, with the probationary period for new violations being two years from August 9, 2004, which is the date the county received the department's administrative complaint. On roll call vote, the motion carried unanimously. 28. ADJOURNMENT MOTION, passed On motion by Mrs. Sorum, seconded by Mr. Wagner and all in favor, the meeting was adjourned at 5:18 PM.
