<br />Commission Minutes--December 20, 2004 2840 <br /> <br />MOTION, passed <br />Mr. Wagner moved and Mr. Pawluk seconded to close the meeting at <br />4:30 PM for the purpose of discussing pending civil litigation and <br />adversarial administrative proceedings based on North Dakota Century <br />Code 44-04-19.1, the exceptions allowed for attorney consultation <br />and/or negotiation. The topic to be discussed is the North Dakota <br />Department of Agriculture v. Cass County. On roll call vote, the motion <br />carried unanimously. <br /> <br />The doors to the Commission Room were closed at this time; and those present in the room <br />were Commissioners Bennett, Sorum, Vanyo, Wagner and Pawluk, State's Attorney Birch <br />Burdick, County Auditor Michael Montplaisir, County Coordinator Bonnie Johnson, County <br />Engineer Keith Berndt, and Administrative Assistant Joyce Schepp. <br /> <br />26. EXECUTIVE SESSION ADJOURNED, Reconvene reaular meetina <br />MOTION, passed <br />Mr. Pawluk moved and Mr. Wagner seconded to adjourn the executive <br />meeting at 5:16 PM. Motion carried. <br /> <br />Mr. Burdick noted that the doors to the Commission Room were opened at this time, and all <br />five commissioners were present. <br /> <br />27. NORTH DAKOTA DEPARTMENT OF AGRICULTURE, Stipulation and consent aareement <br />MOTION, passed <br />Mr. Pawluk moved and Mr. Bennett seconded to authorize settlement <br />with the North Dakota Department of Agriculture for the payment of <br />$3,375.00, with the probationary period for new violations being two <br />years from August 9, 2004, which is the date the county received the <br />department's administrative complaint. On roll call vote, the motion <br />carried unanimously. <br /> <br />28.
