Commission Minutes—August 4, 2014 4334 <br /> The request today is to approve a revenue refunding note because a much lower interest <br /> rate is available. Lyle Erickson, Housing Director for Pioneer House, was present. <br /> MOTION, passed <br /> Mr. Bennett moved and Mr. Vanyo seconded to adopt Resolution #2014- <br /> 13, Resolution Relating to Pioneer House Assisted Living, Inc., <br /> Authorizing the Issuance of Revenue Refunding Notes (Pioneer House <br /> Assisted Living, Inc.), Series 2014, and Approving and Authorizing the <br /> Execution and Delivery of Documents Relating Thereto. On roll call vote, <br /> the motion carried unanimously. <br /> 7. ROAD DEPARTMENT, Maintenance agreement with North Cass Water Resource <br /> District for culvert/drop structure under County Highway 31 <br /> Jason Benson, County Engineer, was present. He said several years ago the National <br /> Resources Conservation Service (NRCS) constructed storm water drop structures as part of <br /> an erosion control improvement project in Section 14 of Wiser Township along County <br /> Highway 31. The North Cass Water Resource District (WRD) served as sponsor of the <br /> project, and the NRCS maintained the site; however, the maintenance period is due to <br /> expire. The drop structure is primarily a culvert located under the highway for water to be <br /> discharged into the river. The county will maintain the structure with annual inspections to <br /> be completed by the WRD. The commission approved a similar agreement in 2012 with <br /> Southeast Cass WRD for two sites along Highway 31. Mr. Benson does not anticipate any <br /> maintenance that will be needed at this site for several years. <br /> MOTION, passed <br /> Mrs. Scherling moved and Mr. Bennett seconded to authorize the <br /> chairman to sign an Operations and Maintenance Agreement between <br /> the North Cass Water Resource District and Cass County, North Dakota <br /> regarding a Critical Area Treatment improvement project in Section 14 of <br /> Wiser Township, Cass County, North Dakota. On roll call vote, the <br /> motion carried unanimously. <br /> 8. ROAD DEPARTMENT, Cost participation and maintenance agreement for Main <br /> Avenue reconstruction project <br /> Mr. Benson said in 2015 the North Dakota Department of Transportation plans to <br /> reconstruct Main Avenue from the 1-94 interchange near the Red River Valley Fairgrounds <br /> to Sheyenne Street in West Fargo. Cass County signed a Memorandum of Understanding <br /> in 2008 agreeing to fund 19% of the cost for an associated multi-use trail outside city limits <br /> as well as maintaining this portion of the trail. The reconstruction project will provide better <br /> turn lanes, improve drainage and eliminate the frontage road. The multi-use path will run <br /> parallel to Main Avenue. The county cost share is $72,725. <br /> MOTION, passed <br /> Mr. Bennett moved and Mr. Vanyo seconded to authorize the chairman to <br /> sign a cost participation and maintenance agreement with the North <br /> Dakota Department of Transportation outlining the responsibilities of the <br /> Main Avenue reconstruction project from the 1-94 interchange to <br /> Sheyenne Street in West Fargo. On roll call vote, the motion carried <br /> unanimously. <br /> 9. COMMISSION POLICY, Section 21.52, Post Issuance Debt Compliance <br /> Michael Montplaisir, Cass County Auditor, said policy and procedures are needed as a <br /> result of the U.S. Bank loan for FM Diversion Authority financing.
