Commission Minutes—August 4, 2014 4335 <br /> compliance procedures the county must follow when issuing the debt. The commission <br /> approved a similar policy in 2010 for the bonds associated with the Courthouse West <br /> Addition project. John Shockley, the county's bond counsel, drafted the policy and <br /> procedures for consideration today, which covers the use of the funds, interest earned, and <br /> maintenance of records. <br /> MOTION, passed <br /> Mr. Vanyo moved and Mrs. Scherling seconded to adopt Commission <br /> Policy Section 21.52, Post Issuance Debt Compliance. On roll call vote, <br /> the motion carried unanimously. <br /> 10. FLOOD DIVERSION MONTHLY BILLING, Approved <br /> Mr. Montplaisir discussed the billing from the FM Diversion Board of Authority for the month <br /> of July, 2014, which is the county's share of engineering costs and project management <br /> services. Also included is the mitigation expense for Ducks Unlimited and replacement <br /> infrastructure costs associated with the OHB levee, of which $49,172 will be submitted to <br /> the State Water Commission for reimbursement. <br /> MOTION, passed <br /> Mrs. Scherling moved and Mr. Bennett seconded to approve the <br /> expenses for the Flood Diversion Board of Authority in the amount of <br /> $727,128.36 for month of July, 2014. Discussion: Mr. Vanyo asked <br /> whether the bill to Dakota Underground in the amount of $109,000 is for <br /> the replacement infrastructure work in Oxbow. Mr. Montplaisir said it is <br /> and that only a portion of the cost ($49,172) will be submitted to the State <br /> Water Commission. On roll call vote, the motion carried unanimously. <br /> 11. VOUCHERS, Approved <br /> MOTION, passed <br /> Mr. Vanyo moved and Mr. Bennett seconded to approve Voucher No. <br /> 279,966 through Voucher No. 280,208. On roll call vote, the motion <br /> carried unanimously. <br /> 12. FLOOD DIVERSION FINANCING; PROPERTY TAX TASK FORCE; BUDGET <br /> MEETINGS; CLAY COUNTY JUVENILE DETENTION, Committee reports <br /> Mr. Montplaisir said the closing was held last week on the $50 million loan with U.S. Bank <br /> for Flood Diversion financing. He said the Finance Committee will consider drawing $20 <br /> million to cover monthly costs in order to build up tax sale dollars. <br /> Mr. Montplaisir will attend a meeting of the Governor's Task Force on property tax reform on <br /> Thursday, August 7th in Bismarck. <br /> Mr. Montplaisir said the deadline to submit annual budgets was August 1St. He said based <br /> on budgets submitted by departments and outside agencies, expenditures will surpass <br /> anticipated revenues for next year. The preliminary budget is being prepared using the zero <br /> increase in mills formula adopted by the state legislature, which will require a 2.57 mill <br /> reduction. He briefly discussed the notice process that will need to be used if the mill levy <br /> increases in any taxing entity, including the county. <br /> Keith Berndt, County Administrator, said a meeting is scheduled for Thursday, August 7th <br /> with officials from the Clay County Juvenile Detention Center to discuss Cass County <br /> leasing space for juveniles at their facility. <br />
