Commission Minutes—May 5, 2014 4293 <br /> MOTION, passed <br /> Mr. Vanyo moved and Mr. Peterson seconded to authorize the County <br /> Auditor to pay outside agencies the remaining 3% cost share from the <br /> 2009 flood in the amount of $42,378.91 with dollars from the 2010 Flood <br /> Fund through ACH deposit or check. On roll call vote, the motion carried <br /> unanimously. <br /> 10. FLOOD COSTS, Payment for clay borrow pit used in 2010 flood <br /> Jason Benson, County Engineer, said during the 2010 spring flood, an immediate source of <br /> clay was needed for an emergency levee in Round Hill Subdivision and Cass County <br /> Highway 81 neighborhoods. The county contracted with Dr. James Carlson to use his <br /> property south of 88th Avenue South and east of 25th Street South. The intent was to pay <br /> for the clay or replace the borrow material. After the flood, the clay was used to complete <br /> permanent levees. He has been in discussions with Dr. Carlson and in lieu of replacing the <br /> clay an offer of $5 per cubic yard was made and agreed to by Dr. Carlson ($100,000 based <br /> on 20,000 cubic yards used). Mr. Benson believes this is a fair agreement in order to settle <br /> the issue with the property owner. <br /> MOTION, passed <br /> Mr. Bennett moved and Mrs. Scherling seconded to authorize the <br /> chairman to sign a contract with Dr. James Carlson for payment in the <br /> amount of $100,000 for the clay borrow pit located at 88th Avenue South <br /> used during the 2010 spring flood. On roll call vote, the motion carried <br /> unanimously. <br /> 11. COUNTY SPACE ANALYSIS AND FEASIBILITY STUDY, Foss Architects and Kimme <br /> Associates selected to conduct study <br /> Mr. Berndt said the county solicited Request for Proposals (RFP) to conduct a space <br /> analysis and feasibility study for future space needs of the Sheriff's Office (juvenile <br /> detention, alternative sentencing, and patrol/investigation office space). Four architectural <br /> firms submitted proposals, and interviews were held on May 2nd by a selection committee <br /> made up of members from the Building Committee. The committee recommends Foss <br /> Architecture / Kimme & Associates be hired to complete the study. Mr. Peterson said <br /> Dennis Kimme knows the county history because he conducted the last space analysis in <br /> 2009. Mr. Berndt said the deciding factor was the level of experience offered by Mr. Kimme. <br /> MOTION, passed <br /> Mr. Peterson moved and Mr. Vanyo seconded to approve the selection of <br /> Foss Architects and Kimme & Associates to complete the space analysis <br /> and feasibility study and direct the county administrator to conduct <br /> contract and fee negotiations. Discussion: Mr. Bennett said since the <br /> juvenile detention space is under consideration, he asked about the <br /> population of juveniles housed at the Cass County Jail. Captain Judy <br /> Tollefson said the daily average is 5 to 6 inmates. She said issues exist <br /> with the location at the jail, and a more appropriate setting for juveniles <br /> is needed. Motion carried. <br /> 12. FLOOD DIVERSION MONTHLY BILLING, Approved <br /> Mr. Berndt discussed the billing from the FM Diversion Board of Authority for the month of <br /> April, 2014. The major expenses are the county's share for consulting services and land <br /> acquisition. <br />
