Comm. Minutes--July '18, 1989 292 REGULAR MEETING OF CASS COUNTY BOARD OF COMMISSIONERS JULY 18, 1989 1. MEETING TO ORDER Chairman Don Eckert called the meeting to order with all members present as follows: Oscar Sondrall, Alon Wieland, Don Eckert, Sharon "Pepper" Toussaint, and Gene Shannon, 2. MINUTES OF PREVIOUS MEETING, Postpone approval NOT~ON, passed Mr. Shannon moved and Mr. Wieland seconded to postpone approval of the July 11, 1989, Commission minutes until the Secretary has a chance to format them on computer and compare them against the tape recording for possible corrections and approval at the next regular meeting. Motion carried. 3. RESOLUTION #1989-11, Sleepy Hollow Street Improvements NOT~ON, passed Mr. Wieland moved and Mr. Shannon seconded to adopt the "RESOLUTION APPROVING CONTRACT AND CONTRACTOR'S BOND IN STREET IMPROVEMENT DISTRICT NO. 1989-1" as presented by Attorney Dan Twichell and as follows: On roll call vote, the motion carried unanimously. BE IT RESOLVED by the County Commission of the County of Cass, Fargo, North Dakota, that it is hereby found, determined and declared that the contract heretofore entered into by and between the County of Cass and Northern Improvement Company is in full conformity with the law, including section 40-22-36 of the North Dakota Century Code; that the contractor's bond of Nodthern Improvement Company heretofore received and filed with the County Auditor is in full conformity with the law including Section 40-22-31 of the North Dakota Century Code; and that the contract and contractor's bond are hereby approved. 4. SLEEPY HOLLOW STREET IMPROVEMENTS, Payment of bills delayed A bill was received from Lightowler Johnson Associates and from Ohnstad Twichell Law Firm for professional services rendered on the Sleepy ttollow street improvement project. Mr. Wieland stated that the bills would be paid from the bonding fund but suggested delaying them unbi I there is money in that fund. Mr. Shannon asked if it is correct that the County is simply an enabling agency, and Mr. Wieland stated that is correct. At the Chairman's suggestion, the Commission was agreeable to deferring payment until the proper time. 5. DISASTER DECLARATION FOR STATE OF NORTH DAKOTA, Drought The Chairman read a copy of notification that Lloyd Omdahl, Acting Governor, declared a drought disaster declaration for the State of North Dakota.
