PROCEEDINGS OF THE BOARD OF COUNTY COMMISSIONERS <br />OF CASS COUNTY, NORTH DAKOTA <br />tio.� tAFd6.�i1- o:— y1B915— <br />REGULAR MEETING OF CASS COUNTY BOARD OF COMMISSIONERS <br />JUNE 10, 1986 <br />Chairman Alon Wieland called the meeting to order and upon roll call, all members were present. <br />Mrs. Stanton moved and Mr. Larson seconded that the minutes of the previous meeting be approved as <br />written. Motion carried. <br />A hearing was held on the Application for Abatement and Settlement of Taxes submitted by Earl W. <br />Benser. Mrs. Stanton moved and Mr. Larson seconded that the abatement be approved in accordance with the <br />recommendation of Clarence Miller, County Director of Tax Equalization. On roll call vote, the motion <br />carried unanimously. <br />A hearing was held on the Application for Abatement and Settlement of Taxes submitted by Clark R. <br />Elmore. Mr. Sondrall moved and Mrs. Stanton seconded that the abatement be approved in accordance with <br />the recommendation of Clarence Miller, County Director of Tax Equalization. On roll call vote, the <br />motion carried unanimously. <br />Attorney Daniel Twichell presented a proposed Quit Claim Deed from Cass County to the City of <br />Argusville for a 1.9 acre tract of land in the SW* of Section 6- 141 -49 lying east of County Highway 81. <br />The tract is subject to easements to the City of Argusville for dike construction purposes and for ditch <br />purposes. States Attorney Robert Hoy stated that the deed is in proper form and has the proper <br />description. The Commissioners concurred that the value of this tract of land is less than $1,000.00. <br />Mr. Larson moved and Mrs. Stanton seconded to sell the property in question to the City of Argusville for <br />the sum of $1.00 and authorize the Chairman to sign the Quit Claim Deed. On roll call vote, the motion <br />carried unanimously. <br />Mr. Charles Kahl, District Engineer for the North Dakota Highway Department, reported that the loss <br />to the State Highway Distribution Fund as a result of the ethanol gas tax exemption will be $11 million <br />during the present biennium; and the loss to Cass County will be $190,000.00 if the current tax exemption <br />is continued. Commissioner Eckert stated that the East Central Commissioners Association, at their <br />meeting held June 9, 1986, went on record opposing the exemption and supporting the State Highway <br />Department's efforts to eliminate the exemption. The Commissioners were in agreement that they will <br />address the issue during the next legislative session expressing their concern for all county, city and <br />state highways. <br />Upon the recommendation of County Engineer Don Richards, Mrs. Stanton moved and Mr. Larson seconded <br />to accept the low bid of General Equipment for $39,500.00 for a used front -end loader for the Road <br />Department. On roll call vote, the motion carried unanimously. <br />Mrs. Stanton moved and Mr. Larson seconded that the Chairman be authorized to sign the contracts <br />with the Northern Improvement Company for two asphalt paving projects, which were awarded on May 20, <br />1986. On roll call vote, the motion carried unanimously. <br />Mr. Eckert moved and Mr. Sondrall seconded to grant a utility permit to Cass County Electric to <br />install an underground power cable under County Road 1 in Rochester Township. On roll call vote, the <br />motion carried unanimously. <br />Mr. Wieland informed the County Engineer that there are two culverts and an access being constructed <br />on County Road 10 to the east of Drain #45. Mr. Richards is aware of the location and stated that the <br />property is in the Riverside city limits. Mr. Wieland felt there should be a service road along County <br />Road 10 rather than so many accesses, and he suggested that Commissioner Eckert and the County Engineer <br />meet with the appropriate officials of Riverside, West Fargo and Fargo regarding access and maintenance <br />of Highway 10. <br />States Attorney Robert Hoy informed the Commission that the North Dakota Attorney General's Office <br />has decided to fund a victim witness advocate position in Cass County contingent upon the County <br />providing local matching funds. The State would place a person in the States Attorneys Office on an <br />annual basis to advise victims and witnesses of crime how to obtain necessary counseling and other <br />services that are available to them. Cost of the position for the first year would be $12,000.00, with a <br />grant from the State for $6,000.00. The County would be requested to match this amount with $3,000.00 <br />being paid from the 1986 budget since the program would begin July 1, 1986. The County would have no <br />obligation for fringe benefits, but would be required to provide clerical and telephone service. <br />Mrs. Stanton moved and Mr. Sondrall seconded to enter into an agreement for a victim- witness <br />advocate position at a cost of $6,000.00, with payment of $3,000.00 from the County Contingency Fund for <br />the period of July 1 through December 31, 1986, and the balance to be budgeted by the States Attorney for <br />1987. On roll call vote, the motion carried unanimously. <br />Administrative Assistant Scott Krueger stated that the Commission needs to determine the term of <br />office for two members of the Salary Review Committee. Mr. Larson moved and Mrs. Stanton seconded that <br />Donna Lays be appointed to a one -year term to expire January 1, 1987; and that Rick Lewis be appointed to <br />a three -year term to expire January 1, 1989.
