PROCEEDINGS OF THE BOARD OF COUNTY COMMISSIONERS G312 OF CASS COUNTY, NORTH DAKOTA REGULAR MEETING OF CASS COUNTY BOARD OF COMMISSIONERS MAY 20, 1986 Chairman Alon Wieland called the meeting to order with four members present, Oscar Sondrall being absent. Mr. Larson moved and Mr. Eckert seconded that the minutes of the previous meeting be approved as written. Motion carried. Jeff Volk from the Moore Engineering Company and Daniel Twichell, Attorney for the City of Argusville, were present regarding a Corps of Engineers proposal to build a flood control levy around the City of Argusville. The City of Argusville would need to obtain an easement approximately 100' wide along County Highway #81. There are six areas designated for sandbag closures which will need to be monitored during potential flooding, and it was suggested that the County Disaster Emergency Services Coordinator be utilized. An easement would be needed to sandbag the highway when there is a flood situation, and Mr. Twichell stated that this would be a very in- frequent occasion. County Engineer Don Richards suggested a cooperative agreement within the County Road #81 right of way rather than an easement. He has no problem with easements outside of the road right of way. Mr. Twichell stated that the type of easement being proposed is basically the same as an agreement, and the Commission asked him to draft an agreement for next week. Mr. Richards stated that he is also concerned with sandbagging the ditch area. Mr. Larson moved and Mrs. Stanton seconded that Cass County deed land outside of the 75' road right of way that is parallel to County Highway 81 within the city limits of Argusville to the City of Argusville, subject to approval of the States Attorney. On roll call vote, the motion carried unanimously. Mrs. Stanton moved and Mr. Eckert seconded to receive and file the petition for upgrading County Road 15 at Kindred between State Highway 46 and Interstate 94. Motion carried. Mrs. Stanton moved and Mr. Larson seconded to approve the request of the Fargo- Moorhead Community Theatre for a Site Authorization Permit for games of chance at the City Limits Truck Plaza. On roll call vote, the motion carried unanimously. Mrs. Stanton moved and Mr. Eckert seconded to grant approval for a Raffle Permit for the F -M Kennel Club on the date of June 1, 1986, at the Red River Valley Fairgrounds. On roll call vote, the motion carried unanimously.. Mr. Wayne Colberg, County Weed Control Officer, appeared before the Board Kellerman's letter and statements made at the Commission meeting last week. Mr. Larson seconded that the Commission receive and file the letter from Wayne Weed Officer. Motion carried. Colberg, Cass County consider implementing a damage another persons 17, easterly: The following bids were received for bituminous surfacing on County Roads 16, 18 and 21: $358,041.20 $433,673.10 $421,755.16 $357,220.20 Mrs. Stanton moved and Mr. Eckert seconded that the above bids be referred to the County Engineer for tabulation and recommendation. Motion carried. The Board recessed for a meeting of the Cass County Building Authority. Upon reconvening, Mrs. Stanton moved and Mr. Larson seconded to approve the Building Authority action on Change Order M -1 in the amount of $10,708.00 for a Class I standpipe system, and to approve the lease agreement with the Cass County Building Authority in the amount of $48,000.00 for the Road Department computer equipment. On roll call vote, the motion carried unanimously. Mr. Eckert moved and Mrs. Stanton seconded to approve Change Order G -9 in the amount of $8,533.00 for the Courthouse remodeling project. On roll call vote, the motion carried unanimously. Mrs. Stanton moved and Mr. Eckert seconded that the County Treasurer be authorized to purchase new book binders from the Knight Printing Company in the amount of $2,790.70, to be paid from Extra Ordinary Outlay.
