Mr. Hendrickson moved and Mr. Sondrall seconded that the minutes of the previous meeting be approved as written. Motion carried. Mr. Hendrickson moved and Mr. Sondrall seconded that the Chairman be authorized ~o sign the permit for the Northwestern Bell Telephone Company to bury cable under County Road 10 and 24 north of West Fargo. Motion carried. Steve Grindberg, County Road Superintendent, reported that it was the intention of the County to remove a bridge and make a channel change and install two lines of concrete pipe on the County Road 5 project south of Interstate 94, and the plans were already drawn up and the letting was supposed to be held in May on that portion of the project. However, now the landowner, Wilfred Marshall, will not sell the right of way for the channel change because he wants a bridge equal to or larger than, what is presently there. Mr. Grindberg stated that the engineers for the project and the State Highway Department feel this will be a sufficient waterway as the plans were drawn up; and the County would not receive funding for a new bridge. Mr. Grindberg recommended that the County finish the 2 miles of grading on the project and leave the present bridge as it stands. Mr. Hendrickson moved and Mr. Sondrall seconded that the County abide by the recommendation of Mr. Grindberg to do only the remainder of the grading along County Road 5. Motion carried. Upon the request of Attorney Jonathan Garaas, Mr. Hendrickson moved and Mr. Sondrall seconded that the Chairman be authorized to sign the following Order of the Board of County Commissioners for the Incorporation of Prairie Rose: Motion carried. Board of County Commissioners of Cass County, North Dakota, having received from the election officials of the City of Prairie Rose, North Dakota, an election return affidavit and verification showing the number of votes cast for incorporation of the City of Prairie Rose to be in number, 30, and the votes cast against incorporation to be in number, 5, and having canvasse~ said return; and the results of the canvas i and the election having been entereu upon the minutes of the proceedings of said ' Board of County Commissioners; and it appearing that a majority of the votes cast at the election favored incorporation, IT IS HEREBY ORDERED: The territory described in the petition is hereby declared to be incorporated as a city under the council form of government to be named the City of "Prairie Rose" which name was prayed for in the petition. A copy of this order shall be entered in the minutes of the proceedings of the Board of County Commissioners of Cass County, North Dakota, and a certified copy of such order shall be filed for record in the office of the Register of Deeds of Cass County and a certified copy shall be filed in the office of the Secretary of State as required by North Dakota Century Code Section 40-02-12. Mr. Sondrall moved and Mr. Hendrickson seconded that the Chairman be authorized to sign the resolution setting the date of May 15, 1979, at the Evald J,. Carlson residence for the election of officers for the City of Prairie ,Rose; and that Brenda Carlson be the temporary acting City Auditor for the City of Prairie Rose to accept nominations for the initial election of officers. Motion carried. Mr. Delos Burley who lives in the SE~ of Section 16, Gardner Township, appeared before the Board concerning the condition of County Road 34 which he maintains is due to the County using bulldozers to open the road for traffic this winter. He stated that the road should have been closed this winter rather than pushing the snow way out in the ditches causing a drainage problem and he stated that no water will be running down the road ditch this year because of the bulldozing. The County Road Superintendent stated that the County Road Department will do the best they can to clean the ditch for Mr. Burley if he sees that he is going to have a water problem. A letter was received from Houston Engineering, Inc. informing the Board of a meeting to be held at 3:00 P.M. on April 19, 1979, at the Fargo City Hall Planning Meeting Room to discuss the Fargo-Moorhead proposed 12th/15th Avenue North bridge. Mr. Hendrickson moved and Mr. Sondrall seconded that all County Department Heads be asked to attend the Commission meeting on Wednesday, April 25th, to discuss preparation of their budgets for the next fiscal year. Motion carried. Mrs. Wold moved and Mrs. Stanton seconded that Vouchers No. 59,433 through No. 60,267 and Revenue Sharing Voucher No. 179 be approved and ordered paid.
