<br />PROCEEDINGS OF THE BOARD OF COUNTY COMMISSIONERS <br />OF CASS COUNTY, NORTH DAKOTA <br /> <br />5847 <br /> <br />ADJOURNED MEETING OF CASS COUNTY COMMISSIONERS <br /> <br />MARCH 28, 1979 <br /> <br />Chairman Satrom called the meeting to order and four members were present, <br />iMrs. Wold being absent. <br /> <br />, Mr. Hendrickson moved and>Mrs. Stanton seconded that the minutes of the previous <br />'meeting be approved as written. !4otion carried. <br /> <br />Steve Grindberg, County Road Superintendent, reported on the request last week <br />;of Mr. Gaylen Nudell to abandone a township road between Sections 5 and 6, Howes Township, <br />Iwhich is dead-ended at Interstate 94. The procedure for abandoning a dead-ended <br />,section line road is that a petition be filed with the Board of County Commissioners <br />Isigned by the person or persons owning the land on both sides of the road, after which <br />!the Board of County Comnissioners shall hold a public hearing. Mrs. Stanton moved and <br />,Mr. Hendrickson seconded that the County Auditor write a letter to Mr. Nudell advising <br />him to write a letter petitioning the Board to close this road. Motion carried. <br /> <br />Mr. Sondrall reported tha't there is a problem of homes in the City of Frontier <br />being flooded, but the County Road Superintendent stated that they have been doing <br />some bulldozing along County Road 6 and plan to have the problem corrected today. <br /> <br />Mr. John Heuer from the City Council of Leonard appeared to request financial <br />assistance from the County to blacktop the township roads leading into the City of Leonard. <br />Mr. Hendrickson suggested that the request be taken under advisement when the Board <br />updates the 5-year construction program and see what the County can do. <br /> <br />Discussion continued on the application received last Wednesday from the <br />Buffalo Wildlife Club for a gambling permit to be held on Friday and Saturday nights <br />:for one year in the Fireside Lounge outside of Buffalo. The County Auditor read an <br />opinion from the Attorney General's Office dated August 8, 1977, stating that they <br />did not feel it would be permissible for a public bar to have tip jars and punch boards <br />on an on-going basis. Local authorization to conduct games of chance must be given on a <br />specific event-by-event basis, defining the date, time and place. <br /> <br />Mr. Hendrickson moved that the Board issue the permit to the Buffalo Wildlife Club <br />in accordance with the rules and regulations set forth by the Attorney General's Office <br />whereby they would have to apply for a specific occasion. However, Mrs. Stanton felt <br />that the Attorney General's opinion discourages this type of gambling in bars and she <br />stated that the County Commission has not issued any permits in bars. Mr. Hendrickson <br />withdrew his motion. <br /> <br />Mrs. Stanton moved and Mr. Hendrickson seconded that the Board deny the application <br />for a Gambling Permit for the Buffalo Wildlife Club to be held at the Fireside Lounge. <br />Motion carried. Mr. Burnell Beilke who submitted the application last Wednesday <br />appeared before the Board later in the morning, and the Board informed him that the <br />application was denied and the $10.00 application fee was returned to him. <br /> <br />Mr. Hendrickson moved and Mrs. Stanton seconded that the Application for a <br />Gambling Permit be granted to the Chaffee High School Senior Class for a raffle to be <br />held at the school on April 23, 1979. Motion carried~ <br /> <br />Mrs. Stanton moved and Mr. Sondrall seconded that Mr. Ben Hahn be reappointed <br />for another 3-year term on the Board of Directors of the Southeast Mental Health and <br />IRetardation Center. Motion carried. <br /> <br />A letter was received from the Cass County Housing Authority stating that the <br />term of Theodore M. Lee expires April 5, 1979.
