<br />H. No person shall perform body art upon any person who is under the influence <br />of either alcohol, drugs or other stimulants or depressants, or any person of <br />unsound mind. <br /> <br />Section 7. Penaltv.--Every person, firm, or corporation violating this <br />article shall, upon conviction thereof, be punished by a fine not to exceed <br />$1000 or by imprisonment not to exceed 30 days, or by both such fine and <br />imprisonment, in the discretion of the Court, the Court to have power to <br />suspend said sentence and to revoke the suspension thereof. <br /> <br />Section 8. <br /> <br />Effective Date. <br /> <br />This ordinance shall be in full force and effect from and after its passage, <br />approval and publication. <br /> <br />APPROVED: <br /> <br />Robyn Sorum, Chair <br />Board of Commissioners of the <br />County of Cass <br /> <br />ATTEST: <br /> <br />Michael Montplaisir, County Auditor <br /> <br />First Reading: <br />Second Reading: <br />Final Passage: <br />Publication: <br /> <br />(SEAL) <br /> <br />SUGGESTED MOTION: <br />Move to approve first reading of Ordinance #2004-3 providing for the regulation of body art <br />establishments and Regulations for Owners and Operators of Body Art Establishments; <br />and to schedule the second reading and adoption for September 7, 2004, allowing time for <br />publishing a summary of the ordinance in the official newspaper at least 20 days between <br />the first and second reading. <br />
