<br /> <br />11 <br />No person, firm, or corporation shall install, alter, repair, or extend <br />any individual on-site sewage system in the county without first <br />obtaining a permit from the designated officer. <br /> <br />The fee for the permit shall be in accordance as set or prescribed by <br />the Cass County Commission. <br /> <br />Application for permits shall be made upon forms furnished by the <br />designated officer and shall be signed by the applicant. Said permit <br />to construct is valued for a period of 12 months from date of <br />issuance. If construction is not started within this period, the permit is <br />void, unless an extension is granted by the designated Health Officer. <br /> <br />The Health Officer shall refuse to grant a permit for the construction <br />of an individual sewage disposal system where a public sewer <br />system is available. <br /> <br />If construction is not started on the building or septic system within 12 <br />months of the date of approval of the application, it will be necessary <br />to resubmit an application and plot plan for the system to assure that <br />the lot or house plan or location have not changed. <br /> <br />SECTION VII – SEVERABILITY <br /> <br />In any section, subsection, sentence, clause, phrase or portion of <br />these regulations is for any reason held to be invalid or <br />unconstitutional by the decision of any court of competent jurisdiction, <br />such decision shall not affect the validity of the remaining portions of <br />these regulations. <br /> <br />SECTION VIII – REGULATION ENFORCEMENT <br /> <br />Malfunctioning private on-site sewage disposal systems (including <br />septic tanks, cesspools, cisterns, dry wells, absorption bed-fields, <br />holding tanks, and the like) are a menace to the health and general <br />welfare of the citizens of this county and are hereby declared to be a <br />nuisance. <br /> <br />Whenever brought to the attention of the Health Officer that any <br />unsanitary conditions exist in any private sewage disposal system or
