<br />Commission Minutes--July 6, 2004 <br /> <br />2753 <br /> <br />The board next reviewed the appeal of B & H Investments. Phil Buhr, Partner, B & H <br />Investments, LLP was present and said he believes B & H's property was assessed at <br />207% above the rest of the entire subdivision where this property is located. He is looking <br />for a fair and accurate valuation of the property to insure that everyone shares equitably in <br />the total burden of property taxation. <br /> <br />Mr. Klein said he believes the assessment of Mr. Buhr's two vacant lots in Dakota Plaza <br />Addition at $27,000 is equitable. He said the lot valuation on which the commercial <br />structure is situated may be somewhat high relative to other lot valuations that contain <br />structures and, therefore, recommends lowering that valuation to $45,000. <br />MOTION, passed <br />Mr. Meyer moved and Mr. Wagner seconded that the commercial lot <br />assessment on Lot 2 Block 1, Dakota Plaza Addition, be lowered from <br />$55,500 to $45,000 for 2004. On roll call vote, the motion carried <br />unanimously. <br /> <br />MOTION, passed <br />Mr. Meyer moved and Mr. Wagner seconded to adjourn the County <br />Board of Tax Equalization for 2004. Motion carried unanimously. <br /> <br />The chair declared a five-minute recess, and the board of county commissioners <br />reconvened at 5:50 PM. <br /> <br />15. ABATEMENT HEARING, B & H Investments <br />Mr. Klein provided a written report on his investigation of abatement application #5252 and <br />#5254 submitted by B & H Investments. He said the applicant, Phil Buhr, is requesting the <br />valuation on Lots 1 & 3, Block 1, Dakota Plaza Addition, Stanley Township, be reduced from <br />$27,800 and $25,000 to $15,000 each for the year 2003. Dakota Plaza Addition was <br />subdivided from Lot 1, Austin's Subdivision. <br /> <br />The Stanley Township Board of Supervisors recommended denial of the abatement <br />applications; however, Mr. Klein recommends lowering the valuation to $15,000 for 2003 on <br />both vacant lots because it would appear the valuation is excessive when compared to <br />other vacant lots in Austin's Subdivision. Also, the local assessor sent a notice of increased <br />assessment to B & H Investments listing a valuation of $15,000 for Lot 3 and a valuation of <br />$27,800 for Lot 1, which was actually placed on the assessment roll at $25,000. Mr. Klein <br />said Mr. Buhr concurs with his recommendation of $15,000 for these two lots. <br />MOTION, passed <br />Mr. Wagner moved and Mr. Vanyo seconded that abatement #4252 and <br />abatement #4254 for B & H Investments be lowered to $15,000, as <br />recommended by the Director of Equalization. On roll call vote, the <br />motion carried unanimously. <br /> <br />Mr. Klein provided a written report on his investigation of abatement application #5253 <br />submitted by B & H Investments. He said the applicant, Phil Buhr, is requesting the <br />$545,000 valuation be reduced to $219,200 for 2003 on his commercial property located on <br />Lot 2, Block 1, Dakota Plaza Addition. <br />
