<br />Commission Minutes--July 6, 2004 <br /> <br />2748 <br /> <br />THEREFORE, BE IT RESOLVED, that the Board of Commissioners of Cass County, North <br />Dakota, does hereby express its condolences to the family of the late Jeannette "Mike" <br />Stanton. <br /> <br />BE IT FURTHER RESOLVED, that this resolution be inscribed upon the permanent records <br />of the proceedings of the Board of County Commissioners and a copy forwarded to her <br />family. <br /> <br />Dated at Fargo, North Dakota, this 6th day of July, 2004. <br /> <br />13. ORDINANCE PROPOSALS, Public swimming pools and body art establishments <br />Mr. Bennett provided sample copies of ordinances and regulations for owners and operators <br />of public swimming pools and for owners and operators of body art establishments. He said <br />the State Health Department no longer monitors such facilities; however, the cities of Fargo <br />and West Fargo have adopted ordinances and regulations that have been used as a model <br />by other jurisdictions. <br /> <br />Mr. Bennett introduced Myron Berglund and Terry Ludlum, from Fargo Cass Public Health, <br />which is the enforcement agency on these health and safety issues. Mr. Berglund said <br />people using public swimming pools, motel pools and whirlpools should be protected from <br />potential diseases. On the issue of body art establishments, he said monitoring does not <br />exist outside of Fargo and West Fargo at this time. He feels strongly that youths under the <br />age of 18 should be required to have parental consent before they can receive any type of <br />tattoos or body piercing, and this is included in the ordinance. These regulations, he said, <br />would help prevent the spread of Human Immunodeficiency Virus (HIV) and Hepatitis B <br />Virus to patients during exposure to invasive procedures. <br /> <br />Mr. Vanyo asked if the Fargo and West Fargo ordinances are identical, and Mr. Berglund <br />said they are the same, as far as he knows. He said the county ordinance may need to <br />address mobile tattoo parlors, which is not included in Fargo's ordinance. <br /> <br />Mr. Wagner asked the State's Attorney, Birch Burdick, about legal issues concerning other <br />political subdivisions if the county is looking for broader coverage to protect the public. Mr. <br />Burdick said other political subdivisions, like municipalities, could adopt an ordinance or sign <br />a joint powers agreement with the county if they want enforcement of the regulations in their <br />respective jurisdictions. <br />MOTION, passed <br />Mr. Bennett moved and Mr. Meyer seconded that the state's attorney <br />draft ordinances and regulations similar to the cities of Fargo and West <br />Fargo regulating public swimming pools and body art establishments, <br />and to schedule the ordinances for first reading on August 2, 2004. <br />Discussion: Mr. Wagner asked if this motion includes working with other <br />municipalities, not to supercede them, and Mr. Bennett concurred that <br />other municipalities, such as Casselton and Kindred, who have public <br />swimming pools, may wish to draft their own ordinances or perhaps <br />enter into a joint powers agreement with Cass County for enforcement. <br />On roll call vote, the motion carried unanimously. <br />
