<br />Commission Minutes--June 21, 2004 <br /> <br />2743 <br /> <br />15. RED RIVER VALLEY FAIR, Citizen complaint about noise <br />Steven Stremick, 450 Westwynd Drive, West Fargo, attended today's meeting to voice a <br />complaint about noise levels at the Red River Valley Fair in West Fargo. His property is <br />very near the fairgrounds, and he polled his neighborhood about their concerns also. His <br />neighbors were in agreement that concerts should end at 11 :00 PM each night of the fair so <br />the neighborhood can get some sleep. They are also concerned about late-night noise from <br />fireworks displays at the fairgrounds. <br /> <br />Mr. Wagner said the Red River Valley Fair Association owns the fairgrounds property, and <br />the county commission has no control or jurisdiction over the sounds at the fair. Jim <br />Thoreson, Chief Deputy Sheriff, and member of the Red River Valley Fair Board, was <br />present. He said he has been involved with the Sheriff's Department and with the fair for a <br />number of years and suggested that Mr. Stremick bring his concerns to the next Fair Board <br />meeting, which will be held this Wednesday at the fairgrounds at 3:00 PM. Mr. Thoreson <br />said concerns have been brought to the Fair Board's attention in the past on fireworks <br />noise, and they put a 1 :00 AM moratorium on the pyrotechnics show two years ago. He <br />assumed the same rules would apply when they return this year. <br /> <br />Mr. Stremick said he has a temporary restraining order with him today, and he intends to <br />rectify the situation. <br /> <br />Mr. Vanyo asked for a comment from Birch Burdick, State's Attorney; and Mr. Burdick said <br />the county does not have a noise ordinance. He said the North Dakota Century Code <br />addresses a couple of specific issues on noise, such as disorderly conduct, that would not <br />appear to pertain to the fairgrounds. As a prosecutor, he advised the appropriate way to <br />handle this situation is for Mr. Stremick and his neighbors to meet with the Red River Valley <br />Fair Association. Mr. Vanyo asked Jim Thoreson to make the arrangements for such a <br />meeting. <br /> <br />16. VOUCHERS, Approved <br />MOTION, passed <br />Mr. Wagner moved and Mr. Vanyo seconded to approve Voucher No. <br />187,966 through No. 188,809. On roll call vote, the motion carried <br />unanimously. <br /> <br />17. JAIL SALVAGE MATERIAL; MEETINGS UPDATE; COUNTY GOVERNMENT <br />MENTORING PROGRAM; WARD COUNTY DETENTION CENTER, Committee reports <br />Bonnie Johnson, County Coordinator, provided copies of a memorandum from Robert Stein, <br />Fargo Senior Planner, concerning the use of historic materials for the Broadway Square <br />Design Competition hosted by the City of Fargo, to be located on the northeast corner of the <br />intersection of Main Avenue and Broadway in downtown Fargo. One of the finalists <br />proposes utilizing some of the metalwork and sandstone panels salvaged from the former <br />Cass County Jail and Sheriffs Residence. Mrs. Johnson outlined the items to be reused in <br />the Broadway Square Design if the California design team of Vargas Greenan Urban <br />Design is selected for the project. She said the county saved more material from the jail <br />than was specified, and it is being stored at the Cass County Highway Department. <br />
