This contract is between the state of North Dakota, acting by and through its Director of Transportation, hereinafter referred to as NDDOT, whose address is 608 East Boulevard Avenue, Bismarck, North Dakota 58505-0700, and Cass County Sheriff's Office, hereinafter referred to as the Contractor, whose address is P.O. Box 488, Fargo, North Dakota 58107-0488. WHEREAS, NDDOT has been delegated the responsibility to administer the state's Annual Highway Safety Plan as authorized in Section 54-0~-05 of the North Dakota Century Code; and WHEREAS, the Contractor requests participation in the state's Annual Highway Safety Plan; THEREFORE, in consideration of the mutual promises herein set forth, NDDOT and the Contractor agree: The Contractor shall perform the project(s) set forth in Appendix A, a copy of which is attached hereto and made a part hereof. The term of this contract shall begin May 1, 2009, and shall end September 30, 2009. NDDOT shall reimburse the Contractor for costs incurred under the terms of this contract, not to exceed $6,500. Reimbursement of all costs under this contract is contingent on federal participation. Allowable costs are covered under 48 CFR Part 31. All requests for reimbursement must be submitted to NDDOT within 45 days of the termination date of this contract. IV. The Contractor shall make all purchases and maintain and dispose of all equipment purchased in accordance with 49 CFR Parts 18.32 and 18.36 or 23 CFR Part 1204, copies of which will be provided upon request.
