North Dakota Department of Transportation AMENDMENT TO CONTRACT NO. N/A Project No. STM-BRO-0009(030) THIS AMENDMENT to the above-referenced contract is entered into by and between the State of North Dakota, acting through its Director of Transportation, hereinafter known as NDDOT, whose address is 608 East Boulevard Avenue, Bismarck, North Dakota 58505-0700, and Cass County, hereinafter known as the Contractor, whose address is c/o County Auditor, P.O. Box 2806, Fargo, North Dakota 58108. WHEREAS, the parties entered into a contract on March 20, 2009; and WHEREAS, to comply with the requirements of Title XV, Subtitle A, section 1511 of the American Recovery and Reinvestment Act (Pub. L. 11 1-5 (Feb. 17, 2009)), hereinafter ARRA. The County will certify that the infrastructure investments for this project, funded with ARRA funds appropriated by ARRA under the heading "Highway Infrastructure Investment" to the Federal Highway Administration, have received the full review and vetting required by law and that the County accepts responsibility that such investments are appropriate uses of taxpayer dollars. The County further certifies that the specific information required by Section 1511 concerning the project investment, will be submitted to the NDDOT; and NOW THEREFORE, the Contractor and NDDOT agree that this language is entered into the original Construction and Maintenance Agreement. 1 of 2 DOT 52494 (Div. 06)
