NOW THEREFORE, the COUNTY, FARGO, and WEST FARGO agree as follows: Section 1. FARGO agrees to transfer to COUNTY the sum of $37,512 for the (Cass County project) Program on or before 30 September 2012. FARGO agrees to transfer to WEST FARGO the sum of $25,629 for the West Fargo Police Patrol Vehicle on or before 30 September 2012. FARGO agrees to transfer to WEST FARGO the sum of $44,160 far the West Fargo Emergency Services Communication Tower Replacement,Program on or before 30 September 2012. Section 2. Nothing in the performance of this agreement shall impose any liability for claims against FARGO other than claims for which liability may be imposed by the North Dakota State Tort Claims Act NDCC 32-12.2. Section 3. Section 4. Each party to this agreement will be responsible for its own actions in providing services under this agreement and shall not be liable for any civil liability that may arise from the furnishing of the service by the other parties.
