Contract Number: <br />THE STATE OF NORTH DAKOTA <br />County of Cass <br />INTERLOCAL AGREEMENT <br />BETWEEN THE CITIES OF FARGO, ND, WEST FARGO, ND AND THE COUNTY <br />OF CASS, ND <br />RECOVERY ACT: JUSTICE ASSISTANCE GRANT (JAG) PROGRAM AWARD <br />This agreement is made and entered in to this 15 day of April, 2009 by and between the <br />COUNTY of CASS, acting by and through its governing body, the County Commission , <br />hereinafter referred to as COUNTY, and the CITY OF FARGO, acting by and through its <br />governing body, the City Commission, hereinafter referred to as FARGO, and the CITY <br />OF WEST FARGO, acting by and through it governing body, the City Commission, <br />hereinafter referred to as WEST FARGO, all of Cass County, State of North Dakota, <br />witnesseth: <br />WHEREAS, this Agreement is made under the authority of NDCC 11-9.1 Home <br />Rule Counties and NDCC 40-05.1 Home Rule in Cities: and <br />WHEREAS, each governing body; in performing governmental functions or in <br />paying for the performance of governmental functions hereunder, shall make the <br />performance or those payments from current revenues legally available to that party: and <br />WHEREAS, each governing body finds that the performance of this Agreement <br />is in the best interests of each parties, that thendertaking will benefit the public, and that <br />the division of costs fairly compensates the performing party for the services or functions <br />under this agreement: and <br />WHEREAS, the FARGO agrees to provide COUNTY $37, 512 from the JAG <br />award for the (Cass County project) Program: and <br />WHEREAS, FARGO agrees to provide WEST FARGO $69, 789 from the JAG <br />award for the West Fargo emergency services communication tower replacement project <br />and West Fargo police patrol vehicle: and <br />WHEREAS, COUNTY and WEST FARGO agree that FARGO shall retain <br />$499,867 for the (Fargo project) <br />WHEREAS, COUNTY, FARGO, and WEST FARGO, believe it is in their best <br />interests to allocate the JAG funds as stipulated. <br />
