<br />Commission Minutes-December 15, 2008 3454 <br /> <br />WHEREAS, Judge Cynthia Rothe-Seeger has distinguished herself in her work <br />over the years, including a term as the Cass County State's <br />Attorney from 1976 to 1981; <br /> <br />WHEREAS, Judge Cynthia Rothe-Seeger has been a conscientious and diligent <br />servant to the citizens of Cass County during her years of service; <br /> <br />THEREFORE BE IT RESOLVED, That the Board of County Commissioners of <br />Cass County does hereby congratulate Judge Cynthia Rothe-Seeger upon her <br />retirement. <br /> <br />BE IT FURTHER RESOLVED, That this resolution be inscribed upon the <br />permanent records of the proceedings of the Board of County Commissioners <br />and a copy be forwarded to Judge Rothe-Seeger. <br /> <br />Dated at Fargo, North Dakota, this 15th day of December, 2008. <br /> <br />j. Amend charity local permit #428 to conduct a poker tournament to be held <br />December 19-21, 2008, at the Knickerbocker Liquor Locker in Hickson, North <br />Dakota, for a Relay for Life benefit. <br /> <br />6. RESOLUTION #2008-17, Second readinQ/adoption of Alcoholic BeveraQe Retail <br />LicensinQ Fees <br />State's Attorney Birch Burdick introduced Assistant State's Attorney Tracy Peters, who <br />drafted the resolution for alcoholic beverage retail licensing fees for consideration by the <br />board. Mrs. Peters said she is present today to answer any questions about the proposed <br />resolution. <br /> <br />Mr. Bennett said with the new fee structure the beer and wine fee will increase from $100 to <br />$500 per year. He asked if county establishments open five or six months each year be <br />allowed to pay half the fee. Mrs. Peters said if the commission wishes, this could be <br />incorporated into the resolution. She said the current beer and liquor license procedures <br />do not include this provision. Mr. Burdick said someone would need to monitor whether <br />these establishments are open for the period outlined in their license. <br /> <br />Mr. Wagner said if an establishment purchases a beer and liquor license, the business is <br />responsible for the hours of operation during the year. He said a fee increase has not been <br />implemented in over 30 years and feels the proposed fee structure is appropriate. <br /> <br />The chairwoman opened the public hearing for comment. Hearing no comments, she <br />closed the public hearing. <br />MOTION, passed <br />Mr. Pawluk moved and Mr. Wagner seconded to approve the second <br />reading and adopt Resolution #2008-17, Alcoholic Beverage Retail <br />Licensing Fees as follows: On roll call vote, the motion carried with Mr. <br />Pawluk, Mr. Wagner and Mrs. Sorum voting "Yes" and Mr. Bennett voting <br />"No" . <br />
