<br />This a!.rreement made and entered into by Cass County, North Dakola, party of the firsl part, and
<br />Industrial Builders Incorooraled, PO Rox 406 Fargo. NU 58107 party or the second part (hereinafter called Contractor),
<br />WITNESSETH:

<br />J. That for and in eonsidL"f"4tion of the payments to be made by lhe pllrly of the fIrst part, the contraclorpmmises and agrees 10
<br />furnish and deliver all labor, equipment, llnd materials, and to payor cause to be paid as they become due, all claims for any work, labor,
<br />malerials, equipment, including equipmenL rental (lr repair, and other supplies or insllrance premiums,. all of which arc allributable to or
<br />utilized in and about the repair project number TB 0901. In accordance and in conformity with the provisions of this contracl, Lhe
<br />sll:lndard speci fication, supplemental specifications, ~"pecial provisions, and the limits of lhe project as outlined in the proposal dated
<br />Oecember 15,2008, the originals or which are on tile at the Cass Counly Highway OI,'Partment, and all ofwhich arc hereby made a parI
<br />of this agreemenl as fully and to the same effect as if the samc had been set forth in the body of this agreement. References in the
<br />Sll:lndat4Spccifications for Road and Brigge ~~.onstruction, 2002 edition, to the North Dakota Oepartment of Transportation or
<br />Dep-.u1ment must. be construed liS retiming to the owner. Likewise, a reference by tJle same works to engineer or director must be
<br />constnJed as referring 10 the owner of the project.

<br />2. The party of the nrsl part i~rrees and promises to pay to the ConLractur t{lr said work, when completed and accepted in
<br />accordance with the provisions of this contracl, the price set tbrth in the said proposal, amounting approximaLcly to
<br />I.wenLy.~scv~!! Thousand Nine Hundred ThirLy Fil!.f;l and 00/100 ($27,935.00), payments to he made as provided in said specifications
<br />upon presentation of the proper certiticates of the COlmty Engineer, or hilol rcpresentatives, and under the tenns of this cont1'8Cl.

<br />3, The said work shall be done in accordance with the tenns of this contract, and the laws ufthe State of North Oakola, under
<br />direct supervision and to the C111ire satisfaction of the COWlty Highway DcparLment, su~iect at all times to the ins)lCction and approval or
<br />the engineer,
<br />
<br />4. The decision of the engineer upon questions connected wilh lhc execution of this agreement or any failure or delay in Lhe
<br />prosecution ofLhe work by the Contractor shall be ('jnal and conclusive.
<br />
<br />5. In the employment of labor, other things being equal, prelcrencc shall be given to honorably discharged Veterans of the
<br />Anned Forces, and bona fide North Dakota residenL..., as dctennined by NDCC Section 43-07-20.
<br />
<br />6. The Contractor shall begin cons1ruction work when so ordcred by the Cass County I Iighway UepiiTtment and shall mainlain
<br />at all times Lhercon a maximum and efficient working lhrce necessary to complete the work wiLhin lhc time established by lhis contract.
