<br />A portion of the East one-half (El/2) of Section twenty-six (26), Twp. one hundred <br />forty north (140 N), Rge. forty-nine west (49W) , 5th P.M., described as the <br />East 62.5 feet of the West 100 feet of said East one-half of Section 26 bounded on <br />the North by the southerly right-of-way ofthe Burlington Northern, Inc., Railroad <br />and bounded on the South by the South line of Section 26, containing 1.347 acres <br />more or less. <br /> <br />(the "Property"). <br /> <br />A copy of the Easement dated August 31, 1976, recorded in the office of the Cass County <br /> <br />Recorder, Cass County, North Dakota, on January 10, 1977, at 2:11 p.m., in Book G-7 of Deeds, <br /> <br />Page 172, as Document Number 513062, is attached as Exhibit A. <br /> <br />Grantor assigns and conveys to Assignee, its successors and assigns, all of Grantor's rights <br /> <br />and interests created in the Property, and all of Grantor's rights and interests in the Easement dated <br /> <br />August 31, 1976, recorded in the office ofthe Cass County Recorder, Cass County, North Dakota, <br /> <br />on January 10, 1977, at 2:11 p.m., in Book G-7 of Deeds, Page 172, as Document Number 513062, <br /> <br />including all rights of access to and from the Property for construction, operation, improvement, <br /> <br />inspection, and maintenance of a legal drain on the Property.
