The staff noticed the generator cooling tower curbs have
collapsed. I contacted Foss Architecture regarding this issue on September 26,
2008, and asked to meet with designers, engineers and contractors to discuss when
the repair will be made and who would pay the costs.

On September 29, 2008, a staff member from Foss Architecture inspected the
structural problems with the generator cooling tower and the generator was started
to observe the vibration. The fresh air intakes in the H pod were inundated with
diesel fumes from the generator stack. The generator has been used twice since
inmates were moved from the G pod to the H pod and both times the pods filled with
diesel fumes. Fumes also infiltrated the new G pod, but with less severity. I have
asked Mr. Hoganson to check with his design team regarding this issue with the two
new pods.

The questions of the Board are as follows:
1) When will the deficiencies be fixed?
2) How will the costs be paid?

I have been waiting for Foss to set up a meeting with Birch Burdick and me. I have
also had Mike Montplaisir visit the site when the problems were first identified. Cass
County would really like to resolve these issues while we still have decent weather to
complete the work.

K:\BJIJAIL GENERATOR STACK & TOWER MEMO.doc
