LEASE AGREEMENT This agreement made and entered into this)Q. day of Sel5tel"ber, 2008, by and between the Page Rural Fire Protection District, herein referred to as "Landlord", and Cass County by the Cass County Sheriff's Oa' herein referred to as "Tenant". WITNESSETH: ~4 J::o 1. Demised Property. The Landlord hereby leases ~ ~ Tenant and the Tenant hereby agrees to rent and lease from the landlord that certain real property located in the County of Cass and the State of North Dakota, which lies on property owned by the Landlord in the City of Page, more specifically identified on the attached Attachment 1 . 2. Term of Lease. The initial term of this lease shall be for a period of Fifty (50) years commencing on January 1, 2009. 3. Rent. In lieu of making annual rent payments to the Landlord, the Tenant agrees to provide Landlord with antenna locations, at no cost to the Landlord. The antenna locations may be used by landlord or any other governmental agency, business or individual so designated by Landlord provided that use does not conflict with the Tenant's radio equipment nor impair the performance of the Tenant's communications system. Any Tenant associated costs due to impairment facilitated by addition of equipment will be the responsibility of the operator of the respective equipment. 4. Use of Property. The Demised Property shall be used for the construction and operation of an antenna tower approximately 100 feet in height and such other uses as are reasonably related thereto. 5. Compliance with Law. The Tenant shall comply with all federal, state and municipal laws, ordinances and regulations applicable to the use of the demised property. /:)~;A Landlord's Responsibilitv.
