<br />LEASE AGREEMENT <br /> <br />This agreement made and entered into this 30 day of September, 2008, by and <br />between the Alice Fire District, herein referred to as "Landlord", and Cass County by <br />the Cass County Sheriff's Office, herein referred to as "Tenant". <br /> <br />WITNESSETH: <br /> <br />1. Demised Property. The Landlord hereby leases to the Tenant and the Tenant <br />hereby agrees to rent and lease from the landlord that certain real property <br />located in the County of Cass and the State of North Dakota, which lies on <br />property owned by the Landlord in the City of Alice, more specifically identified on <br />the attached Attachment 1. <br /> <br />2. Term of Lease. The initial term of this lease shall be for a period of Fifty (50) <br />years commencing on January 1, 2009. <br /> <br />3. Rent. The Tenant shall pay Landlord, as rent, the annual sum of $1200.00 due <br />within 30 days of the first of each year beginning in 2009. Landlord and Tenant <br />further agree that a reduction in rent by mutual agreement may occur during the <br />life of this lease for consideration of Tenant locating radio or other equipment on <br />the tower structure owned or benefiting the Alice Fire District. <br /> <br />4. Use of Property. The Demised Property shall be used for the construction and <br />operation of an antenna tower approximately 100 feet in height and such other <br />uses as are reasonably related thereto. That Tenant has exclusive right of use <br />and control of said Demised Property. <br /> <br />5. Compliance with Law. The Tenant shall comply with all federal, state and <br />municipal laws, ordinances and regulations applicable to the use of the demised <br />property. <br /> <br />6. Landlord's Responsibilitv. Landlord will provide space for the location of a utility <br />cabinet for the housing of any radio related equipment and supply all required <br />utilities. Said utility expenses are included in and is part of the rental payment <br />made annually by the Tenant. <br />
