LEASE AGREEMENT This agreement made and entered into this 30 day of September, 2008, by and between the Alice Fire District, herein referred to as "Landlord", and Cass County by the Cass County Sheriff's Office, herein referred to as "Tenant". WITNESSETH: 1. Demised Property. The Landlord hereby leases to the Tenant and the Tenant hereby agrees to rent and lease from the landlord that certain real property located in the County of Cass and the State of North Dakota, which lies on property owned by the Landlord in the City of Alice, more specifically identified on the attached Attachment 1. 2. Term of Lease. The initial term of this lease shall be for a period of Fifty (50) years commencing on January 1, 2009. 3. Rent. The Tenant shall pay Landlord, as rent, the annual sum of $1200.00 due within 30 days of the first of each year beginning in 2009. Landlord and Tenant further agree that a reduction in rent by mutual agreement may occur during the life of this lease for consideration of Tenant locating radio or other equipment on the tower structure owned or benefiting the Alice Fire District. 4. Use of Property. The Demised Property shall be used for the construction and operation of an antenna tower approximately 100 feet in height and such other uses as are reasonably related thereto. That Tenant has exclusive right of use and control of said Demised Property. 5. Compliance with Law. The Tenant shall comply with all federal, state and municipal laws, ordinances and regulations applicable to the use of the demised property. 6. Landlord's Responsibilitv. Landlord will provide space for the location of a utility cabinet for the housing of any radio related equipment and supply all required utilities. Said utility expenses are included in and is part of the rental payment made annually by the Tenant.
