DEPARTMENT OF THE ARMY
CORPS OF ENGINEERS, OMAHA DISTRICT
1616 CAPITOL AVENUE
OMAHA NE 68102-4901

REPLY TO
ATTENTION OF

September 23,2008

Real Estate Division

SUBJECT: Termination ofCass County Licenses Granted to the Federal Government

County Auditor
Cass County, North Dakota
P. O. Box 2806
Fargo, North Dakota 58108-9732

Dear Sir:

Weare writing regarding a road license, which was granted by Cass County to the Federal
Government in March 1964, for the purpose of connecting a road that led from a Minuteman Missile site
(Missile Site M-22) located on private lands, to a Cass County road. The Government sold this former
missile site to a private landowner whose lands surround or adjoin the former missile site or to a person
who bid on the site during a General Services Administration auction. As this license interest does not
run with the underlying land ownership interests, the Federal Government is now required to terminate
the license.

We would appreciate your county's cooperation in the termination of the license interest granted by
and located in Cass County. We have enclosed a copy of the original license agreement (for Site M-22)
between the United States and Cass County dated March 31, 1964 (Enclosure 1). A license termination
agreement, which provides information on the location of the license site, is also enclosed (Enclosure 2).

Please sign and return the enclosed license termination agreement, indicating the county's agreement
with the termination of the Government's real estate interest. The remaining copy is for your records.
A return envelope is enclosed for convenience. After the termination agreement has been signed on
behalf of the Department of the Air Force, a fully executed copy will be returned to you. If you have
any questions, please write to me at the above address or telephone Mr. Walt Noordam of my staff at
(402) 995-2849.

Sincerely,

~42S?

Brad A. Terrill
Chief, Military Branch
Real Estate Division, Omaha District
U. S. Army Corps of Engineers

Enclosures

SUGGESTED MOTION:

Move to authorize the chairman to sign a termination of license agreement originally issued in
1964 with the United States Army Corps of Engineers for use of a road located in the WX of
SWX in Section 17 Township 143 Range 55, Cass County.
