<br />\." <br /> <br />SUBJECT POLICY # Page of <br />MOTOR VEHICLE PURSUIT 1.09 5 of7 <br /> <br />1. The reasons for initiating the pursuit; i.e. the alleged offense. <br />2. The identity of all deputies's involved in the pursuit. <br />3. The length of the pursuit, including the duration and distance traveled and <br />estimated speeds of the vehicles involved (both the police vehicle and the <br />fleeing vehicle). <br />4. The outcome of the pursuit, including a description of any personal <br />injuries or property damaged as a result of the pursuit. <br />5. The report will also detail any and all criminal charges related to the <br />pursuit. <br />6. The shift supervisor will also be responsible for the review of the <br />deputy(s) actions during the course of the pursuit to determine if the <br />actions were in accordance to the set policy and procedures. <br /> <br />VIII. POLICE VEHICLE OPERATON AND TACTICS: <br /> <br />A. <br /> <br />Deputy's are cautioned and reminded that the authority to operate an <br />emergency vehicle while engaged in a motor vehicle pursuit does not protect <br />the driver of such emergency vehicle form the consequences for recklessly <br />disregarding the safety of others (NDCC 39-09-06). <br /> <br />\.. <br /> <br />B. Intentional or deliberate contact between a pursuing police vehicle and a <br />fleeing vehicle; i.e. forcing the fleeing vehicle into parked cars, ditches, or any <br />other obstacle, or heading off, ramming, or driving alongside a fleeing vehicle <br />while it is in motion, is Drohibited unless specifically authorized by the shift <br />supervisor. A police vehicle may be used to block or "box-in" a fleeing <br />vehicle, but only if the fleeing vehicle has come to a complete stop and only if <br />the risk of injury to any person (including other deputy's and the occupants of <br />the fleeing vehicle) is minimal. <br /> <br />C. Deputy will adhere to all applicable laws and department policies regarding <br />the use of force, including deadly force, when engaged in a motor vehicle <br />pursuit. The use of any roadblock will be considered only when authorized by <br />the shift supervisor, and only when the use of deadly force would be <br />iustified. <br /> <br />D. <br /> <br />Police units involved in a motor vehicle pursuit should be spaced at a distance <br />that ensures proper braking distance and allows for sufficient reaction time in <br />the event the lead vehicle stops, slows, or turns. Deputies involved in a <br />pursuit will not attempt to pass other police units unless specifically requested <br />or directed to do so by the primary police unit involved in the pursuit or the <br />shift supervisor. Furthermore, there will be no "caravanning" or paralleling of <br />the pursuit unless specifically authorized by the shift supervisor. When <br /> <br />\... <br />
