The Office of Professional Standards will evaluate the complaint and will <br />determine if the complaint is an inquiry about policy or procedure, or whether <br />it is a complaint that must be investigated by the Office of Professional <br />Standards. <br /> <br />D. If it is determined an investigation is warranted, the Office of Professional <br />Standards will assign the complaint an OPS complaint number and open an <br />investigation. <br /> <br />E. The employee, who has received the complaint, and their immediate chain of <br />command, will be notified by the Office of Professional Standards by email <br />and a written memorandum of the complaint against them. <br /> <br />F. The notifications will contain information regarding the type of complaint and <br />specific Office of Professional Standards instructions regarding the complaint. <br /> <br />G. <br /> <br />The Office of Professional Standards will contact the employee for an <br />interview. The employee may bring an observer to their interview if they so <br />desire. The observer may be an attorney, supervisor or anyone the employee <br />deems appropriate. The person may only observe and may not ask any <br />questions, give advice, or interrupt the interview. If the observer violates this <br />request, they will be asked to leave the interview. This is a courtesy given to <br />the employee by the Sheriff and may be revoked at anytime. <br /> <br />\.., <br /> <br />H. Any employee who is found to have lied during an internal investigation may <br />be terminated. <br /> <br />I. In Supreme Court rulings law enforcement agencies are required to notify the <br />prosecutor of any "sustained" charges against an officer for falsifying reports <br />or other conduct which could impact their truthfulness. 1963 Brady v <br />Maryland and other cases set forth the requirement that the prosecutor must <br />disclose any information and or evidence to the defense that is exculpatory and <br />could be used to impeach a witness. Specifically, the prosecutor is required to <br />disclosed "sustained" charges against a law enforcement officer for any <br />conduct that could impact their reputation for truthfulness. This may also <br />include alleged conduct prior to an investigation depending on the nature and <br />seriousness of the allegation. This may also include off duty conduct as well. <br /> <br />J. Once the investigation is complete the Office of Professional Standards will <br />document its findings and make a recommendation to the Sheriff as to the <br />complaint disposition.
