In some, if not all, juvenile court jurisdictions, North Dakota Century Code 27-20 is interpreted
to allow only the local juvenile court to approve the use of secure detention for a juvenile. For
the purpose of SDSS reimbursement for secure detention, either the local juvenile court or an
individual authorized by the juvenile court must approve the detention,

F. Payment Reimbursement Procedures

DJS has established a funding formula for the reimbursement of costs associated with the three
components of the SDSS Program. Reimbursement schedules and the required documentation
are discussed in detail in the individual descriptions of the components. In general however,
Attendant Care and Transportation costs will be reimbursed in full and Detention costs will be
reimbursed on a 50 percent basis. An exception is that all renovation approved for
reimbursement for either supervision setting, must be matched on a dollar-for-dollar basis.

All jurisdictions or private agencies that elect to provide Attendant Care will have a signed
agreement between themselves and DJS regarding expectations and arrangements for the
provision of SDSS. These guidelines, including the specifications regarding payment procedures
and payment schedules, will be made a part of the agreement.

DJS requests that any billings for reimbursement of services be submitted upon completion of
each month. DJS or its designee will pay each provider following completion ofthe month, after
services have been established and verified. The local jurisdiction or private agency may
establish the format for billings, as long as the information and documentation detailed in the
following sections is provided. If the agency does not have a preferred billing format, proposed
formats are provided as Appendix Band C.

July 2008 - Page 2
