GMS APPLICATION NUMBER: 2008-F4409-ND-DJ The State of North Dakota } } County of Cass } INTERLOCAL AGREEMENT BETWEEN THE COUNTY OF CASS AND THE CITY OF FARGO 2008 BYRNE JUSTICE ASSISTANCE GRANT (JAG) PROGRAM AWARD This Agreement is made and entered into this 16th Day of June, 2008 by and between the County of Cass, acting by and through its governing body, the Cass County Commission, hereinafter referred to as COUNTY, and the City of Fargo, acting by and through its governing body, the Fargo City Commission, hereinafter referred to as CITY, both of Cass County, State of North Dakota, witnesseth: Whereas, each governing body finds that the performance of this Agreement is in the best interests of both parties, that the undertaking will benefit the public, and that the division of costs fairly compensates the performing party for the services or functions under this agreement: and Wheras, the total amount of2008 JAG funds is $31,353.00 Whereas, the County will retain $5,000.00 and agrees to provide the City $26,353.00 from the JAG award; and Whereas, the County and City believe it to be in their best interests to reallocate the JAG funds. NOW THEREFORE, the County and City agree as follows: Section 1: The County will apply for the available grant funds. The County agrees to pay City a total of$26,353.00 for JAG related expenditures prior to the 2008 Byrne Justice Assistance Grant (JAG) Program Award's expiration date. Section 2: The County agrees to use $5,000.00 for JAG related expenditures prior to the 2008 Byrne Justice Assistance Grant (JAG) Program Award's expiration date. Section 3: Each party to this agreement will be responsible for its own actions in providing services under this agreement and shall not be liable for any civil liability that may arise from the furnishing of the services by the other party.
